15 the aforesaid Charles Croson his damages aforesaid to twelve hundred and forty two pounds of tobacco and seven pounds twelve Shillings and four pence Currant Money by the same Charles in form aforesaid Confessed as also three hundred & Seventy 370 pounds of tobacco for his Costs and Charges afd to the same W.m at his request by the Court her and of the Consent of the parties afd adjudged which Certain Damages in the whole do amount to Seven pounds twelve shillings and four pence Currant Mony and pounds of tobo and the afd deft in Mercy &c
tenth day of November Anno Dom One thousand Seven hundred and twenty Eight at Somerset County within the Jurisdiction of this Court was Indebted unto the aforesaid Handcock in his Lifetime in the Sum of thirty bushells of Indian Corn and Six hundred pounds of tobacco by account and so thereof being Indebted the same Charles in Consideration thereof afterwards to witt the Same day and Year afd at the County aforesaid and within the aforesaid Jurisdiction upon himselfe assumed and to the same Handcock in his Life time then and there did faithfully promise that he the said Charles when afterwards he Should be thereunto Requested he the aforesaid Sum of thirty bushells of Indian Corn and Six hundred pounds of tobacco to the Same Handcock in his Lifetime would well and faithfully Content and pay Nevertheless the aforesaid Charles his promise and assumption aforesaid in form aforesaid Made Little Regarding but Plotting & fraudulently Intending him the Same Handcock in his Lifetime nor the aforesaid John since his death to whom Execution of the Last will and testament in due form of Law was Committed in that part Craftilly and Subtilly to defraud and deceive he the said Charles the aforesaid thirty Bushells of Indian Corn and six hundred pounds of tobacco to the same Handcock in his Life time or to the aforesaid John since his death hath not paid or him for it in any wise Contented altho the said Charles was Often thereunto requested by the said Handcock in his Lifetime to witt the same day and year afd at the County aforesaid within the Jurisdiction afd but the said Charles the Same hitherto to pay or the same Handcock in his Lifetime or the aforesaid John since his death for it in any wise Contented hath altogether refused and Still doth refuse whereby the same John says he is worse and hath damage to the value of sixty bushells of Indian Corn and twelve hundred pounds of tobacco and thereof he brings Suit &.c and brings hereinto Court the Letters testamentary afd &c by which &c L Gale P Quer Pledges &c Jno Doe R Roe And the said Charles Ramsey by francis Allen his attorney Comes and defends the force and Injury when &c and prays Leave thereof to Imparle hereunto untill the next Court and hath it and the Same day is Given to the afd plantiffe here also &c Att which said next Court to witt the Eighteenth day of August Anno Dom One thousand Seven hundred and thirty Came again as well the afd John Custis Executor as aforesaid as the aforesaid Charles Ramsey by their attorneys afd and whereupon the Said Charles Says that he Cannot Gainsay the action aforesaid of the afd John nor but that he did assume upon himselfe in manner and form as the afd John above against him hath Complained and as to the damages of the Same John by him by Occasion of the premises in that part sustained the same Charles says and Confesseth that the afd John has Sustained damages by Occasion of the premises further than his Costs and Charges by him about his Suit in that part apposed to thirty bushells of Indian Corn and Six hundred pounds of tobacco and not more and because the afd John Denys not his but the Same allegation Confesseth to be true prays Judgmt and those damages above Confessed together with his Costs and Charges afd to him adjudged &.c Therefore it is Considered by Consent of the parties afd that the afd John Custis Executor as afd Recover against the Said Charles Ramsey had damages afd to the afd thirty bushells of Indian Corn and Six hundred pounds of tobacco by the same Charles in form afd Confessed as also two hundred & fifteen pounds of tobacco for his Costs and Charges afd 215 to the same John at his request by the Court here and Consent of the Parties afd adjudged & the afd deft in Mercy &.c |
