Cause aforesaid before that time well Committed & Thereupon the aforesaid Francis Caughlin & Mary Folio were again Committed (by the Court here) into the Custody of the Said Sher & that he Should have them at the next provinciall Court to be held at the City of Annapolis the third tuesday of Aprill next &c & Likewise it is ordered by the Court here that the presentment afd and the Severall evidences Recognizances be transmitted to the Same provinciall Court at the time and place afd &c
Whereupon a Certain James Merrill and William Brittingham of Somerset County Gent present here in Court undertakes for the said John Gaff and acknowledged themselves Indebted unto his Lordship the Right Honrble the Lord proprietary in forty pounds Sterling each of their Goods and Chattells Lands and tenements seperately to be made and Levied to the Use of his said Lordship his heirs and Successors &c In case the said John Gaffe do not make his personall appearance ^before ye Justices^ of the next provinciall Court to be held at the City of annapolis the third tuesday of aprill next and do not then and there prosecute the Said Francis Caughlin and Mary Folio of and Concerning Such matters as they stand Charged with and do not Give Such Evidence as ^he^ shall know against them concerning the Same and do not depart the Same Court without Lycence thereof &c Likewise the aforesaid Joshua Merrill with Benjamin Holland of Somerset County planter his security both present here in Court acknowledged themselves to be Indebted unto his Said Lordship the right honrble the Lord proprietary in forty pounds Sterling each of their Goods and Chattells Lands and tenements seperately to be made and Levied to the Use of his said Lordship his heirs and Successors &c In case the Said Joshua Merrill do not make his personall appearance before the Justices of the next provinciall Court to be held at the City of Annapolis the third tuesday of Aprill next and di not then and there Give such evidence as he shall know against the Said Francis Caughlin and Mary Folio of and Concerning such matters as they stand Charged with and do not depart the Same Court without Lycence thereof &c Likewise |
