147 In case the Said Richard Mitchell do not Learn his Said apprentice during his Servitude to Read write and Cypher as far as the rule of three (Inclusive) and the trades of a Cordwainer and Tanner and at the Expiration of his Servitude do not Give him a new Suit of Cloaths over and above his Common wearing Cloaths and a Compleat set of Cordwainers Tooles and Likewise if he do not provide for his Said apprentice meat drink washing Lodging and Cloathing mete for Such an apprentice to have and weare during the term aforesaid &c
Lord One thousand Seven hundred and thirty One with force and armes &c in the County of Somerset aforesaid & within the Jurisdiction of this Court four yards and one quarter of a yard of Sattin of the Value of thirty six pounds of tobacco each Yard two pair of Shoe buckles of the Value of Nine pounds each pair two yards of muslin of the Value of Seventy two pounds of tobacco each Yard One felt hat of the value of thirty Six pounds of tobacco and one horn Comb of the Value of Six pounds of tobacco of the Goods and Chattells of a Certain James Donelson then and there found then and there feloniously stole took and Carried away against the peace of Right honrble the Lord proprietary &c and also against the form of the act of assembly in that Case made and provided &c Levin Gale Cl Indictments Wittnesses John Gass, Thomas Benston, William Boston, Jane King, Richard Sanders Eliz.a Birmingham Joshua Merrill On the backside of the foregoeing bill of Indictment it was thus Endorsed viz.t Billa Vera Edward Rownd Foreman Whereupon Cometh the aforesaid Francis Caughlin and mary Folio under Custody of Joshua Caldwell Gent.m Sher of Somerset County into whose Custody for the Cause aforesaid before that time ^were^ was Committed to the barr here Led in their proper persons who were Committed to the afd Sher and Instantly of the felony aforesaid in the Indictment afd above Specified being severally asked left how they will acquitt themselves thereof the same Francis Caughlin and Mary Folio Severally Say that they are not thereof Guilty and thereof of Good & evill ^did^ putt themselves upon the Country Therefore Immediately Cometh there of the Jury here before his Lordships Justices for the County afd and who neither &c to recognize &c and the Jurors of the Same Jury by the aforesaid Sher being Impannelled who being Called Came to witt Parker Selby John Purnall Jun.r Peter Frazer Joshua Sturges, John Roach John Brittingham, Robert Mitchell John Webb, Richard Knight Isaac Atkinson, Thomas Purnall & Tho.s Collins who to say the truth of and upon the premisses being elected tryed and sworn And for as much as it doth appear to the Court here upon Evidence Given upon the premisses afd that there was an actuall Burglary Committed so that the same was not determinable in this Court thereupon at the prayer of Levin Gale Esq.r who for his said Lordship in this behalfe did prosecute that John Purnall Jun.r one of the Jurors afd may be withdrawn which is Granted and all the rest of the Jurors ^were^ are discharged |
