Att which Said next Court to witt the Seventeenth day of august ann Dom One thousand Seven hundred & thirty one
Came againe as well the Said John Dennis by his attorney aforesaid as the said Eliz.a Townsend by in her proper person
in Custody as afd and whereupon further day is Given to the afd Elizabeth in Custody as afd by the Court here untill
the next Court and the Same day if Given to the afd plft here also &c

       Att which said next Court to witt the Sixteenth day of November ann Dom One thousand Seven hundred & thirty
One Came againe as well the aforesaid John Dennis by his attorney aforesaid as the aforesaid Elizabeth Townsend
in Custody as afd  And thereupon the Said John Dennis prays that the said Eliz.a to his declaration afd
may answer but the Said Elizabeth altho' Solemnly Called Came not but made default nor Says nothing in barr or
preclusion of the action aforesaid of the aforesaid John by which the Same John Remaines against the Said Eliz.a
thereof undefended       wherefore the same John his damages by occasion of the premisses against the afd Eliz.a
ought to recover but because it is unknown what damages the afd John hath Sustained by Occasion of the nonperformance
of the promise and assumption afd   therefore Command is to the Sherr of Somerset County that by ye
Oath of honest and Lawfull men of his bailywick or County he diligently Enquire what damages the afd John
has Sustained as well by Occasion of the non performance of the promise & assumption aforesaid as for his
Costs and Charges by him about his Suit in that part apposed and the Inquisition which thereof taken the
Sher make appear to the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday
of March next under his Seal and the Seales of them by whose Oath the Same Inquisition is taken he send
together with the writt thereof directed &c

 Command was Given to the Sherr of Somerset County that he Should take William Whittington
late of Somerset County Gent if he Should be found in his bailywick and him
Should safe keep so that he might have his body before the Justices of his Lordships County
Court of Somerset to be held at dividing Creek the third tuesday of November then next to Satisfie Henry
Spear of Seven hundred and Seventy Nine pounds of tobacco which to the Same Henry in the Same Court before
the Justices thereof were adjudged for his damages which he had by Occasion of the Nonperformance of
a Certain promose and assumption to the Same Henry by the afd William Lately made whereof he is Convict &c
Att which said next Court to witt the third tuesday of November ann Dom One thousand Seven hundred and
thirty One Came the Said Henry Spear by Francis allen his attorney and the Sherr of Somerset County to
whom the foregoeing writt was directed  Likewise Comes and makes Return thereof to the Court here Endorsed
in these words following viz.t         Cepi Corpus P Jos Caldwell sher

whereupon the said Sher altho' Solemnly Called brings not in the body of the Said William Whittington according
to the reason of his writt afd but makes default &c
