141 aforesd sum of two hundred and fifty pounds Currant money unto the same John hath not Rendred but the said Sam.ll the same to Render hath Denyed and Still doth Deny and Unjustly Detain whereof the same John Riggin says he is worse and hath Dam to the Value of one hundred pound Currant money and thereof he brings this suit &.c And the said John brings here into Court the Writing obligatory aforesd which &.c T Bluett P Quer pledges &.c Jno Doe R Roe And the said Samuel Riggin by Francis Allen his attorney Cometh and defendeth the force and Injury when &.c and prayed Leave thereof to Imparle here untill the next Court and he had it and the Same day is Given to the afd John here also &.c Att which said next Court to witt the fifteenth day of June ann.o Dom One thousand Seven hundred and thirty One Came againe as well the aforesaid John Riggin as the aforesaid Samuel Riggin by their attorneys aforesaid And whereupon the Same Samuel prayed further Leave thereof to Imparle here untill the next Court and he had it and the Same day is Given to the aforesaid John here also &.c Att which said next Court to witt the seventeenth day of August anno Dom One thousand seven Seven hundred and thirty One Came againe as well the aforesaid John Riggin as the aforesaid Samuel Riggin by their attorneys aforesaid And whereupon the Same Samuel as before defends the force and Injury when &.c and saith that he of the debt aforesaid by Vertue of the writing aforesaid ought not to be charged because he saith that the writing aforesaid is not the deed of him the Said Samuel and of this he putts himselfe upon the Country &.c and the plft Likewise &.c Thereupon Command was Given tot he Sher of Somerset County that Immediately he Cause to Come here twelve &.c by whom &.c who neither &.c to Recognize &.c because as well &.c of which Said preceipt the Said Sher to witt Joshua Caldwell Gent now hereat this day to witt the Same day and Year Last mentioned Comes and makes Return that he hath here ready twelve &.c as by his Said preceipt he was Commanded and now hereafterwards to witt same day ^& year^ Came as ^well^ the Said plft as the afd deft by ^their attorneys afd^ and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt Edmond Hough William Handy, Samuel Hopkins Jun.r, Hutton Hill, Thomas Peal, Wm Smith, Robert Hall, W.m Broughton William Porter John Pitts, Thomas Hearne, David Dredon who being duely Elected tryed and Sworne to say the truth in the premisses upon their Oath do say that the writting aforesaid ^is the deed^ of him the same Samuel Riggin as the aforesaid John Riggin above against him hath declared &.c And because the Justices here themselves will advise of and upon the premisses before Judgment thereupon Rendered day is Given to the afd John her untill the next Court of hearing thereof his Judgm.t for that the Same Justices here thereof as Yett &.c Att which said next Court to witt the Sixteenth day of November anno Dom One thousand seven hundred and thirty One Cometh as well the afd John as the afd Samuel by their attorneys aforesaid and whereupon the premisses being seen and by the Justices here fully understood &.c It is Considered that the afd John Riggin take nothing by his writt and declaration afd but he in mercy for his falce Clamour and that the Said Samuel Riggin Goe thereof without day &.c |
