140 and sixty seven pounds of tobacco and not more and because the afd Edward deny's not this but the Same allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges aforesaid to him adjudged &.c Therefore by Consent of the parties aforesaid it is Considered that the aforesaid Edward Beachamp Recover against the aforesaid Thomas Newbold his damages aforesaid to Six hundred and Sixty Seven pounds of tob.o 248 by the same Thomas in form aforesaid Confessed as also two hundred & Forty Eight pounds of tobacco for his Costs and Charges afd to the Same Edward at his Request by the Court here and Consent of the parties aforesd adjudged which Certain damages in the whole do amount to pounds of tobacco and the aforesaid Thomas in mercy &.c
Creek the third tuesday of November then next to answer unto Thomas Bannister of a plea of trespass upon the case &.c and that thereof he Should not fail &.c Att which Said third tuesday of November to witt the Sixteenth day of the Same month anno Dom One thousand Seven hundred and thirty One being the day of the return of the Said writt Cometh the Said Thomas Bannister by his proper person and the Sher of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed viz.t Cepi Corpus P Joshua Caldwell sher And the said James Phillips by francis Allen his attorney Cometh and defendeth the force and Injury when &.c and the Said Thomas Bannister altho' Solemnly Called Cometh not nor further prosecutes his writt afd against the Said James Phillips &.c Therefore it is Considered that the afd Thomas Bannister and his pledges of prosecuting be in mercy and that the plft name his pledges &.c and that the afd James Goe thereof without day It is also Considered that 148 One hundred & Forty Eight pounds of tobacco to the Same James by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the Statute thereof Lately made and provided by the court here adjudged &.c
And whereupon the Said John Riggin by Thomas Bluett his attorney saith that whereas the aforesd Samuel the fifteenth day of September anno Dom one thousand Seven hundred and thirty at somerset County within the Jur of this Court by his Certain Writing obligatory Granted himself to be Indebted to the said John in the full sume of two hundred and fifty pounds Currant money of Maryland to be paid the said John Riggin when afterwards he should be thereto Requested Yet the aforesd Samuel altho often thereto Required (the) |
