        August Court        1730                 13

and hereupon the same Thomas prays further Leave thereof to Imparle here untill the next Court and he hath it and the Same
day is Given to the afd plft here also

          Att which Said Next Court to witt the Seventeenth day of the same month One thousand Seven hundred and twenty Nine
Came againe as well the aforesaid William Wale as the aforesaid Thomas Pridix by their attorneys aforesaid and hereupon
the same Thomas Predix prays further Leave thereof to Imparle here untill the next Court and he hath it and the Same day is
given to the aforesaid Plft here also

                  Att which said next Court to witt the Sixteenth day of June anno Dom One thousand Seven hundred and thirty Came
againe as well the aforesaid William Wale as the aforesaid Thomas Pridex by their attorneys aforesaid and hereupon the same
Thomas Predix prays further Leave thereof to Imparle here untill the next Court and he hath it and the Same day is Given to the
afd Plft here allso &c
                                        Att which said next Court to witt the Eighteenth day of August anno Dom One thousand Seven hundred
and thirty Came again as well the aforesaid WIlliam Wale as the afd Thomas Predix by their attorneys aforesaid and
the said Thomas Predix by his said attorney as before defends the force and Injury when &.c and Saith that he did not assume
upon himselfe in manner and form as the said William above against him hath Complained and of this he putts himselfe upon
the Country and the plft in LIke manner

                   Thereupon Command was given to the sher of Somerset County that Immediately he Cause to Come here twelve
&.c by whom &.c who neither &.c to recognize &.c because as well &.c of which said preceipt the Said sher to witt John
Purnall Gent.m  Now here at this day to witt the Same day and Year Last Mentioned Makes Return that he hath here ready
twelve &.c as by his said Preceipt he was Commanded and now hereafterwards to witt the Same day and Year Came as well
the afd plft ad the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called ^likewise^ Came to witt
William Handy John Townsend Jun.r William Ennis John Mercy Robert Mitchell William Colebourn, Thomas Hearn
Walter Darby Abraham Smith James Jones William Mills George Benston who being duely Elected tryed and sworn
to say the trueth in the premisses upon their Oath do Say that the aforesaid Thomas Predix did assume upon himselfe
in manner and form as the aforesaid William Wale above against him ^hath^ Complained and they assessed the damages of
the same William by Occasion of the non performance of the promise and assumption afd beyond his Costs and Charges by him
about his Suit in that apposed to Eleven pounds twelve shillings and Eight pence Currant Money and for those Costs and Charges to
One pound of tobacco
                                           Therefore it is Considered that the aforesaid Wale Recover against the aforesaid Thomas Predix
his damages afd to Eleven pounds twelve shillings and Eight pence Curr.t Money & one pound of tobacco by the Jurors afd in form
afd assessed as also two thousand one hundred and Eighty two   pounds of tobacco for his Costs and Charges to the
2182   same W.m by the Court hereof his assent of Increase adjudged which Certain damages in the whole do amount to Eleven pounds
twelve shillings and Eight pence Currant Money and two thousand one hundred & Eighty two   pounds of tobacco and ye
aforesaid Deft in Mercy &.c

Somerset ss     Benjamin de Le bruse late of Somerset County planter was
attached to answer unto James Robertson of a plea of trespass upon the Case &c
And whereupon the Same James Robertson by Levin Gale attorney Complaines
    that whereas the Said James a good true and faithfull Subject of Our Lord the King now is and of good name fame
    Conversation and reputation amongst all faithfull Subjects of Our said Lord the king and of his progenitors
    to whom the Same James was known from the time of his Nativity was Ever Reputed and never any felony perjury
    murder adultery fornication or any such wicked or base Crime ever Committed or perpetrated or from the procureing
    of such like wickedness or of the Same in any manner whatsoever noted or Suspected by the whole Cause of his life
    hitherto hath remained free and unsuspected by Reason whereof the said James Great Goodwill good opinion
