139 is Given to the aforesaid Robert Here also &.c Att which Next Court to witt the fifteenth day of June Anno Dom One thousand seven hundred and thirty One Came againe as well the aforesaid Robert as the aforesaid William by their Attorneys aforesaid and whereupon the Same William prayed further Leave thereof thereof to Imparle here untill the next Court and he had it and the Same day is Given to the afd Robert here also &.c Att which said Next Court to witt the Seventeenth day of Aug.t am Dom one thousand Seven hundred and thirty one came again as well the aforesd Robert as the aforesd William by their attorneys aforesd and whereupon the same William prayed further Leave thereof to Imparle here untill the Next Court and he had it and the same day is Given to the aforesaid Robert here also &.c Att which said Next Court to witt the Sixteenth day of November ann Dom one thousand Seven hundred and thirty one came again as well the aforesd Robert as the aforesd William by their attorneys aforesd and whereupon the same William as before Defends the force and Injury when &.c and Saith that he did not assume upon himselfe or promise to pay to the said Archibald James or Robert Smith in manner and forme as the aforesd Robert above against him Complains and of this he puts himself upon the Cuntry &.c and the Plef.t Likewise &.c whereupon the afd Robert his writt and declaration afd against the aforesaid William will not with Effect further prosecute but voluntaryly Suffered his Suit to be discontinued &.c Therefore it is Considered that the aforesaid Robert Adm.r as aforesaid take nothing by his writt and declaration aforesaid but that he and his pledges of prosecuting to witt John Doe & RIchard Roe be in mercy and that the aforesaid William Boyne goe thereof without day &.c
thereof he Should not fail &.c Att which Said third tuesday of June to witt fifteenth of the Same Month ann Dom One thousand Seven hundred and thirty One being the day of the return of the same writt Cometh the Said John Riggin Owten by James Shirly his attorney and the Sher of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt Cepi Corpus P John Purnall sh And the Said John Riggin by Levin Gale his attorney Cometh and defendeth the force and Injury when &.c and prayed Leave thereof to Imparle here untill next Court and he had it and the Same day is Given to the afd John Owten here also &.c Att which Said next Court to witt the Seventeenth day of August ann Dom One thousand Seven hundred and thirty One Came againe as well the aforesaid John Owten as the aforesaid John Riggin by their attorneys aforesaid and whereupon the Same John Riggin prayed further Leave thereof to Imparle here untill the next Court and he had it and the Same day is Given to the afd Jn.o Owten here also &.c Att |
