138 Cometh and maketh Return thereof to the Court here Endorsed viz.t To the Justices within Mentioned and by vertue of the Within Writt to me directed I Certifie that I have attached as the Goods and Chattells of the within named James Harristoy in the hands of John Horsey Jun.r to the Value of Seventy two pounds and Six pence Currant money of Maryland and Eighteen Hundred pounds of tobacco and by William Handy and Littleton Townsend Good and Lawfull men of my Bayliwick I have made known unto the Said John Horsey that he be and appear at the time and place within Contained before the Justices within mentioned to shew &.c as by the within preceipt I am Commanded Joshua Caldwell Whereupon the Said John Horsey Garnishee of the aforesaid John Harristoy altho' Solemnly Called Came not but made default &.c Thereupon the Said Hannah Waldron by her attorney aforesaid prays that upon Giveing Security according to act of assembly in Such Case made and provided the afd Sum of Seventy two pounds ^and Six pence^ Currant money of Maryland and Eighteen hundred pounds of tobacco so as aforesaid attached in the hands of the aforesaid John Horsey may be Condemned as of the Goods and Chattles of the Said John Harristoy towards satisfying unto the Said Hannah Waldron the Sum of Seventy two pounds ^& Six pence^ Currant money of Maryland and Eighteen hundred pounds of tobacco as also all Costs accrewing upon the writt of attachment aforesaid &.c Thereupon a Certain Nathaniel Horsey of Somerset County Gent present herein Court undertakes for the Said Hannah Waldron that if in Case the Said John Harristoy do at any time within a year and a day appear and make all or any part of the Said Hannah Waldrons Claim against him appear to be Satisfied or Otherwise to have been undue before the Laying of this attachment that then the said Hannah Waldron Shall make Restitution unto him the said John Harristoy of all or Such part thereof as shall be made appear to be undue &.c or that he the Said Nathaniel Horsey will do it for her &.c Therefore it is Considered by the Justices here that the afd Sum of Seventy two pds ^and Six pence^ Curr.t money of maryland and Eighteen hundred pounds of tobacco so as aforesaid attached be Condemned in the hands of the Said John Horsey Jun.r as of the Rights and Creditts of the Said John Harristoy towards Satisfying unto the Said Hannah Waldron admrx as afd as well the Sum afd attached as also al Costs accrewing upon the writt of attachment afd and that the Said Hannah have thereof her Exn agt the Said John Horsey according to act of assembly &.c
unto him the Just and full sum of twenty one pounds and four pence Currant which to him he oweth and Unjustly detaineth &.c And Whereupon the Same John by W.m Beckingham his attorney saith that whereas the aforesd Walter the Eight day of July ann Domini one thousand Seven hundred and thirty one at somerset County within the Jurisdiction of this Court by his Certain Writing obligatory |
