137 provided if to him her or them it Shall seem meet and how you shall Execute this Writt that you make known unto our said Justices at the day and place aforesaid and have you then and there this Writt Wittness Sam.ll Hopkins Gent Chief Justice of our said Court the Ninth day of october in the Seventeenth Year of our Dominion &.c Ann Dom one thousand Seven hundred and thirty one At which said third tuesday of November to witt the Sixteenth day of the Same month ann Dom one thousand Seven hundred and thirty One being the day of the Return of the Same Writt Cometh the Said John Purnall by francis Allen his attorney and the Sher of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof Endorsed vizt By vertue of the within Writt to me directed to the Justices within mentioned I Certifie that I have attached as the Goods and Chattles of the within Named Richard Duskey in the hands of Moses Duskey to the value of twelve hundred and fifty pounds of tobacco and Likewise by Richard Parrimore and John Doe Good and Lawfull men of my Bailywick I have made known unto the Said Moses Duskey that he be and appear at the time & place within Contained before the Justices within Mentioned to Shew &.c as by the within preceipt I am Commanded &.c Joshua Caldwell sher Whereupon the Said Moses Duskey Garnishee of the afd Richard Duskey altho' Solemnly Called Comes not Nor Shews Cause why &.c but makes default Thereupon the Said John Purnall by his attorney afd present herein Court prays that upon Giving Security according to act of assembly in Such Case made and provided the afd Sum of twelve hundred and fifty pounds of tobacco so as afd attached in the hands of the aforesaid Moses Duskey may be Condemned as of the Goods and Chattells Rights and Creditts of the Said Richard Duskey towards Satisfying unto the Said John Purnall the afd twelve hundred and fifty pounds of tobacco in the writt afd mentioned as also all Costs accrewing upon the Same writt &.c Whereupon Francis Allen of Somerset County Gent present herein Court undertakes for the Said John Purnall that if in Case the Said Richard Duskey do at any time within a year and a day appear and make all or any part of the Said John Purnalls Claim against him appear to be Satisfied or any ^other^ ways to have been undue before the Laying of this attachment that then the Said John Purnall Shall make Restitution unto him the Said Richard Duskey of all or such part thereof as shall be made appear to be undue &.c or that he ye Said francis Allen will doe it for him &.c Therefore it is Considered by the Justices here that the aforesaid sum of twelve hundred and fifty pounds of tobacco so as afd attached be Condemned in the hands of the Said Moses Duskey as of the Rights and Credts of the Said Richard Duskey towards satisfying unto the Said John Purnall as well the Sum of twelve hundred and fifty pounds of tobacco as also all Costs accrewing upon the writt of attachment afd and that the said John Purnall have thereof his Execution against the Said Moses Duskey &.c |
