136 Requested he the afd Sum of six pounds tenn Shillings Sterling unto the Said Edmond Jenings would well & faithfully Content and pay Nevertheless the Said John his promise and assumption aforesaid in form afd made not Regarding but plotting and fraudulently Intending him the Said Edmond in that part Craftilly & Subtilly to defraud and deceive ^he^ the Said John Justice the Said Sum of Six pounds tenn Shillings nor any part of it unto the Said Edmond Hath paid or him for it in any wise Contented altho' the Said John the Same to do afterwards to witt the same day and Year aforesaid at the aforesaid County by the Said Edmond was Requested but ^he^ the Same hitherto to do hath altogether Refused and Still doth Refuse to the damage of the Said Edmond thirteen pounds Sterling and thereof he brings this Suite &.c L Gale P Quer pledges &.c Jno Doe R Roe Whereupon the Said John Justices present herein Court at the prayer of the plantife by his attorney aforesaid is adjudged to Give Speciall Bail to the action afd Thereupon a Certain George Doughlas of Somerset County Gentleman present here in Court undertakes for the Said John Justices that if in Case the Said Edmond Jenings Shall Recover Judgm.t in the plea aforesaid against the Said John Justices or that the Said John Justice Shall be therein convict that then he the Said John Justice shall pay the Condemnation of the Court thereupon or Render his body to the Custody of the Sher of Somerset County in satisfaction thereof or that he the Said George Doughlas will do it for him &.c And the Said John Justice by George Doughlas his attorney Comes and defends the force and Injury when &.c and Says that he Cannot Gainsay the action aforesaid of the afd Edmond nor but that he assumed upon himselfe in manner and form as the aforesaid Edmond above against him Complained and as to the damage of the Same Edmond by him by occasion of the premisses in that part Sustained the Same John Says and Confesseth that the aforesaid Edmond has Sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his Suit in that part apposed to Seven pounds thirteen Shillings and Nine pence Sterling and not more and because the aforesaid Edmond denyes not this but the Same allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges afd to him adjudged &.c Therefore by Consent of the parties aforesaid it is Considered that the afd Edmond Jenings Recover against the aforesaid John Justice his damages afd to the afd seven pounds thirteen Shillings and nine pence Sterling by the SAme John in form afd Confessed as also 245 pounds of tobacco for his Costs and Charges afd to the Same Edmond at his request by the Court her and Consent of the parties afd adjudged with Stay of Execution untill next Court which Certain damages in the whole do amount to seven pounds thirteen Shillings and Nine pence Sterling and pounds of tobacco and the afd deft in Mercy &.c |
