135 of Land Called Barbers Rest and they began and run from a tree Lying then in the River Side vizt Wickacomoco by the bankside about two perches below a vally not far from the now dwelling house of Robert Hardy and where now a Ceader post with Sixteen Notches is Sett and was the first bounder of the Said Land as he was then told by the Said James Hardy & further Sayeth not 29 The deposition of James Hardy aged thirty Years or thereabouts being Sworn upon the holy Evangelist &.c Saith that at this place being the place upon the River Side above mentioned in the former deposition where now is Set a Ceader post marked with Sixteen Notches his father James Hardy told him it was the first bounder of his Land Called Barbers Rest and devided between him and the Land of Richard Hull and further Saith not Thomas Humphrys (in the former deposition) was then Enterlined wittness Ja Makmorie
then Next to answer unto John Justice of a plea that he render unto him five pounds Curr.t money of Vergenia which to him he Owes and Unjustly detaines &.c and that there of he Should not fail &.c Att which Said third tuesday of November to witt the Sixteenth day of the Same month ann Dom One thousand Seven hundred and thirty One being the day of the return of the Same writt Cometh ^the Said John Justice by Geo Douglas his attorney and^ the Sherr of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh Return of the Same writt to the Court here Endorsed in these words following vizt Cepi Corpus P Jos Caldwell sher And afterwards the Same day and Year aforesaid before his Lordships Justices at Dividing Creeks in the County afd Cometh the aforesaid Edward Adams by Levin Gale his attorney and the aforesaid John Justice by his attorney aforesaid then and there his writt aforesaid against the aforesaid Edward Adams will not further prosecute with Effect but voluntarily permitted his Suit to be discontinued Therefore afterwards vizt at that same day by discretion of the Justices here were adjudged the Same Edward Adams pounds of tobacco for his Costs and Charges 148 by him about his defence in that part Sustained according to the form of the Statute in Such Case Lately made and provided and the afd John Justice in Mercy and that the afd Edward have thereof his Execution
And Whereupon the Same Edmond Jenings by Levin Gale his attorney Complains |
