134 deponant to drive the aforesaid Stake into the Marsh and further Saith not
appointed you or any three or two of you to be our Commissioners to Examine ^evidences^ on behalf of a Certain Robert Hardy of the County aforesaid in Relation to the bounds of ^a^ tract of Land Lying in the County aforesaid Called Barbers Rest we therefore Require you or any three or two of you at some time and place as to you or any three or two of you Shall Seem Convenient you meet on the aforesd Land Called Barbers REst (you first having taken your oath on the holy Evangelist of Almighty God According to act of assembly in Such Case made and provided) and there Cause to Come before you or any three or two of you all Such Evidences as Shall be to you or any three or two of you Nominated by the Said Complainant or Deft (if any) and that you or any three or two of you Administred on the holy Evangelist of Almighty God in the presents of the Complainant (or Deft it any touching the truth or Remembrances of their knowledge or any thing that may Relate to the Cause aforesaid and that reducing the Severall depositions into Writing you send the SAme together with this our Commission under your or any three or two of your hands ot us to our County Court of Somerset With all Convenient Speed Wittness Saml Hopkins Gent Chief Justice of our said Court the Eighteenth Day of June in the Seventeenth Year of our Dominion &a Ann Dom one thousand Seven hundred and thirty one Now hereat to witt the Sixteenth day of November one thousand Seven hundred and thirty one came hereinto Court Thomas Humphrys and James Makmorie two of the Commissioners mentioned in the above Commission and make return of the Same with Severall depositions as followeth vizt July ye 26.th 1731 Came Thomas Humphrys and Mr James Mackmorie and was Sworne on the holy Evangelist of almighty God to execute the within Commission according to an Act of assembly in Such Case made & provided before me John Handy Somerset County ss Memorand.m that this day to witt the 27.th day of August ann.o 1731 we the Subscribers viz.t Thomas Humphrys and James Makmorie by vertue of a Commission hereunto annexted ^did^ mett upon the Land mentioned in the Said Commission Called Barbers rest belonging to Robert Hardy in this County and in Relation to the first bounder of Said Land took the following depositions &.c Imprms The deposition of Robert Givan aged sixty two years or thereabout being sworn upon the holy Evangelist Saith that about tenn years ago Old James Hardy Imployed him the deponant to Survey the Said Tract of |
