134 Somers^e^t ss This Day to witt the 5.th Day of November 1731 Came before me the Subscriber John Miller and John Holland and was Quallified by taking their Corperall Oaths well and truly to Execute the Within Commission According to the tennor and Effect thereof as Wittness my hand the day above Written Sa Hopkins The Execution of the Within Commission and the Severall Affidavitts thereunto annexed was Duly taken this fifth Day of November ann Dom 1731 By us the Subscribers John Miller John Holland In obedience to the above Commission Directed to John Miller John Tingle John Tull and John Holland all of Somerset County to Examine Evidences Relation to the bounds of two tracts of Land the one Called Cords Lott and the other Cowes Quarter we have meet on the Said Lands this fifth Day of November ann Dom 1731 Being first Sworne before one Justice John Miller and John Holland prosedeth to the 'Examination of Evidences as followeth M.r Samuel Hopkins Sen.r Aged Sixty three years being first Sworn on the holy Evangelist of Almighty God Saith that about twenty years ago by Vertue of a Commission Directed to him and one William Robinson out of Chancery being both Justices of Somerset County to Examine Coll William Whittington and what other Evidences he Should Nominate Concerning the Mouth of the Inlett Creek and Accordingly the Said Whittington Directed us to the bottom of a Neck of Land where Cap.t John Smith now Liveth and Declared on his Corperall oath their was the mouth of the Creek Where he begun to Survey a tract of Land Called Cords Lott where he ordered a Ceader post to be artificially Stuck in the marsh which said post or near the Same place is now Standing to the best of his knowledge and further saith not Mr Benjamin Aydelott aged Sixty One Years being Sworn as aforesaid saith he was Sumoned an Evidence on the aforesaid account and One Walter Reed with Coll Whittington and that the aforesaid Ceader Stake now Standeth near the place where the aforesaid Whittington swore was the mouth of the Creek where the Land Called Cords Lott and Cowes Quarter was both Bounded and that Same Considerable time before he Carried the Chain when the Said Whittington Resurveyed the afd tract of Land Called Cowes Quarter and that he begun at the place aforesaid for the mouth of the Inlett Creek and further Saith not Mr William Smith aged 37 Years being Sworn as afd Saith that he was with Coll ^Willm^ Whittington when he went to the afd Bounders and that the place or near the place where the afd Ceader post now Standeth was the beginning of Cords Lott and that he Ordered the Said deponant |
