134 Now hereat to witt the sixteenth day of November One thousand Seven hundred and thirty One Came here into Court James Martin and James Rownd two of the Gent.m Nominaned in the afd Commission and makes returne of the Same Commission and affidavitts as followeth viz.t This day to witt the 28.th day of October 1731 Came before me the worshipfull James Martin in his proper person and was qualified by taking his Corporall Oath duly to Execute the the within Commission according to the tenor and Effect thereof as wittness my hand the day above written Sam Hopkins November the 2.d 1731 Then Came Mr James Rownd One of the within ^mentioned^ Commissioners before me the Subscriber and was duly Qualified to Execute the within Commission Sworn before me Jam.s Martin In Obedience to a precept hereunto annexed we the Subscribers having given due notice on the Second day of November anno Dom 1731 Met on the Land Mount hope in the possession of Joseph Brittingham Complainant (no deft) Came Archibald Deal an Evidence aged about forty One Years and being Sworn on the holy Evangelist of almighty God Saith that about Eighteen or Nineteen Years ago that Old Hugh Tingle Came to this deponants ^house^ and told him that the first bounder of Olivers Portion stood to the Eastward of a marked beach which Said Beach this deponant took to be a bounder of Olivers Portion and that this deponant renewed the Marks of the Said Beach and that this deponant with Isaiah Bredall and one Thomas Brown Came by the Said Browns directions from the Said Beach (after that Southy Whittington had Surveyed Mount Hope) to a stake but did not at that time find the first Bounder which Said Stake this deponant thinks it to be a little to the Northward of the Supposed first Bounder of Olivers Portion and that the Said Thomas Brown rid up and down from the Said Stake to Look for the bounder of mount Hope but did not find it upon that they went to Isaiah Bredells house and afterwards the Said Isaiah Came out with this deponant and told him he took a marked white Oake Standing by a swamp side next to the Said Isaiahs plantation to be the first bounder of Olivers Portion according to a plott that the aforesaid Thomas Brown Shewed to Isaiah that he had from annapolis and further this deponant Says that Old Tingle told him that he was Informed that Mount Hopes and Olivers Portions bounder stood near to one another and that he took the first bounder of One William Browns Land Stood a very Little to the Northeast of Olivers Portions Bounder and further Saith not The Same day Came Joseph Gray an Evidence aged about thirty Nine Years and being Sworn on the Holy Evangelist of Almighty God Saith that about a hundred paces north North East from a pound and about twenty seven paces from the Corner of Isaiah Bredalls apple orchard there or thereabouts stood a marked Beach tree before the Said Ground was Cleared which he was Informed and always was deemed to be a bounder of Olivers Portion but Now no beach tree appears and further Saith not And also the same day Came Thomas Gray and Evidence aged about twenty four Years and being Sworn on the holy Evangelist of Almighty God Saith that about Nine or ten Years agon he Lived at Isaiah Bredalls and at the place above described he saw a beach Stuarp but don't Remember possitively of the Marks but that the Said Bredall told him it was the Second Bounder of Olivers Portion and that the Surveyor |
