133 Heard John Roberts alias Grandee make oath that the pine Stump (Decribed in John Laws Deposition on the other side) was the first bounder of Ellots Choice and that his father Francis Roberts told him Several times that the said pine Stump was the first bounder of Ellots Choice and further this Deponant Saith that he heard John Windsor Sen.r make oath that Francis Roberts told him that the aforesaid pine Stump was the bounder of Ellots Choice and that he had Seen the tree with the marks on it four Natches on four Sides and further Saith not John Miller Aged 57 Years or thereabouts Deposed on the Holy Evangelist of Almighty God for Edw.d Roberts Def.t Saith that 39 Years agoe Last October he was hunting on a Saturday Night and his Dogs treed two Raccoons up a Large pine tree Marked with Sixteen Notches Standing on a point of Woods by a marsh side to the South ward of Edward Roberts House the Stump of which this Deponant now Stands by and in the Morning Francis Roberts Came to him and Shot Down the Raccons and told him it was well that he did not fall that tree and further Saith not The aforesaid Depositions taken the 29.th of April Ann 1731 on the aforesaid Land Called Ellots Choice by Thom.s Dashiell Robert Jones
any three or two of you to be Our Commissioners to Examine Evidences on behalfe of a Certain Joseph Brittingham of the County aforesd in Relation to the Bounds of a tract of Land Lying in the County aforesd Called Mount Hope we therefore Require you or any three or two of you at Some time and place as to you or any three or two of you Shall seem Convenient you meet on the aforesaid Land Called mount Hope (you first having taken your oaths on the holy Evangelist of Almighty God According to act of assembly in Such Case made and provided) and there Cause to come before you or any three or two of you all Such Evidences as shall be to you or any three or two of you Nominated by the Said Complainant or Deft and that you or any three or two of you Examine them upon their Corporall Oaths to be by you or any three or two of you administred on the holy Evangelist of Almighty God in the presents of the Complainant or defend.t if any touching the truth or the remembrances of their knowledge or anything that may relate to the Cause aforesaid and that reduceing the Severall depositions into writing you Send the Same together with this Our Commission under Your or any three or two of your hands to us to Our County Court of Somerset with all Convenient Speed wittness Samuel Hopkins Gent Chiefe Justice of Our Said Court the Seventeenth day of august in the Seventeenth Year of Our Dominion &.c Ann Dom One thousand Seven hundred and thirty one Now |
