November Court            1731         132

Commission from the worshipfull the Justices of Somerset County Court to us directed whose Names are
hereunder written viz.t
                                                    John Tull Jun.r aged twenty three Years or thereabouts being
by us Sworn upon the holy Evangelist of Almighty God deposeth and Saith that about the
beginning of Last Spring he being in Conversation with his Grand Mother Comfort Benton she
told that she believed that John Harris or Some of his Children had done Very Ill in Barking
a Bum Standing near the foot of a Causway at the North End thereof by the Side of the branch w.th Gum
at the time of this deposition taking was in his view and that she told him it was One of the bounders
of her Land Called bear point and that by her discourse at that time she believes the Said Gum to very
tree she Called a bounder as above and further Saith not                              John Tull Junr

                   Stephen Odear aged Sixty four Years or thereabouts being also by Us Sworn as above
deposeth and Saith that about thirty Years ago or upwards he was told by his brother in Law
Stephen Coston dec.d who was first possessor of the Land Called Bear point that the Land he had
Given to his daughter Elizabeth the now wife of William Townsend Rann through the plantation
whereon Isaac Coston now Lives and further Saith not                        his

                George Tull aged fifty Years or thereabouts being also by Us Sworne as above deposeth and Saith
that about twenty years agoe he was present upon the Land Called Harris his adventure
that from thence they Runn through John Harris his orchard that the Courses Left Out some few
apple trees and that from thence they they Angled to avoid Going through the Swamp till they Came
to a marked Gumm Stand by the Side of an Old path on the North Side of ^a^ branch which path was allowed
by all the Neighbours present to be the Old path or way to Gett over the branch formerly which Induces
him to believe the Said Gum now in his view and Sworn to by John Tull to be the Very Gum reputed to
be one of the bounders of Bear point and further Saith not                  Geo Tull

Edward Harper aged thirty Nine Years or thereabouts being also by Us Sworn upon the holy Evangelist
of Almighty ^God^ deposeth and Saith that when Stephen Costen and his Brother Isaac Costen were
deviding their Land which he believes to be about Seventeen Years ago or more and that at that time
Peter Benton who then Lived upon the aforesaid Land Shoed him the Gum Sworn to by George
Tull and John Tull Jun.r and told him positively that it was One of the bounders of the Land Called
Bear point and further Saith not                                                         his

          Comfort Benton aged Seventy Years or thereabouts being also by us sworn as above deposeth and
Saith that the Gum above mentioned then in her view is her Marked tree and that she Knew of no
