131 the premisses aforesaid above upon him Imposed submitts with a protestation of his Innocency and putts himselfe upon the favour of the Court &.c Whereupon all and Singular the premisses by the Court being here Seen heard and fully understood It is Considered by the Court here that the afd Daniel Maddox pay to his Said Lordship for his fine by the Court here upon him Imposed for and by Occasion of the breach of the peace afd whereof he is Convict fifty pounds of tobacco and that the Same Daniel Maddox be taken to satisfie his Said Lordship of the fine aforesaid &.c thereupon the Said Daniell Maddox is discharged from his Recognizance &.c Robert Ennis and Lewis Rigsby appears according to their Recognizance and are discharged from the Same &.c
we have appointed you or any three or two of you to be our Commissioners to Examine Evidences on behalf of a Certain Isaac Coston of the County aforesaid in Relation to a Line of marked trees which Divides the Land Whereon John Harris now Lives and the tract of Land in possession of John Tull from the Land where Isaac Coston lives we therefore Require you or any three or two of you at some time and place as to you or any three or two of you shall ^Seem^ Convenient you meet on the aforesaid Land /you first having taken your oath on the holy Evangelist of Almighty God according to act of assembly in Such Case made and provided/ and there Cause to Come before you or any three or two of you all Such Evidences as shall be to you or any three or two of you Nominated by the Said Complainant (or Def.t /if any/) and that you or any three or two of you Examine them upon their Corporall oaths to be by you or any three or two of you administred on the holy Evangelist of Allmighty God in the presents of the Complainent (or Def.t) if any touching the truth or Remembrances of their knowledge or any thing that may relate to the Cause aforesaid and that reducing the Severall Depositions into writing you send the Same together with this our Commission under your or any three or two of your hands to us to our County Court of Somerset with all Convenient Speed wittness W.m Planner Gent one of our Justices of our said Court the twentyeth Day of march in the Sixteenth Year of our Dominion &.c Ann Dom one thousand Seven hundred and thirty And afterwards the Same Commission was Returned to the Court with the following Endorsment and Likewise to the Same Commission it was annexed the Execution of this Commission appears in |
