128 the Same James says that he Cannot deny but that he is Guilty of the premisses afd in the Information aforesd above upon him Imposed in manner and form aforesaid against him Supposed and the premisses in the Information aforesaid Expressly Confesseth whereupon all and singular the premisses by the Court being seen and fully understood It is Considered that the afd James Smith pay to his Lordship the Right honrble the Lord proprietary six hundred pounds of tobacco for his fine for the premisses afd in the Information aforesaid Contained whereof he is Convict and that the Said James Smith be taken to satisfie his Said Lordship of the fine afd whereupon it is ordered by the Court here that the afd James Smith Give Security for the payment of the fine afd and the Severall officers fees due by Occasion of the premisses afd thereupon Joseph Caldwell of Somerset County Gent present herein Court undertook for the Said James Smith to pay the fine afd and the Severall Officers fees due by Occasion of the premisses afd &.c whereupon it is Ordered by the Court here that the Said James Smith Give Recogniz.a [illegible] Security in forty pounds Sterling Each to Save and keep Endempnified from time to time and at all times forever hereafter the Justices of Somerset County afd and their Successors for the time being as also the Inhabitants of the Said County from all Costs Charges and troubles whatsoever for or by reason of the birth maintainance nourishment and bringing up of the Child begott of the aforesaid Rachell Walton &.c Thereupon the Said James with the aforesaid Joshua Caldwell both present herein Court acknowledged themselves to Owe and Stand Justly Indebted unto his Lordship the Right honrble the Lord proprietary in the Sum of Forty pounds Sterling Each of their Goods and Chattells Lands or tenements Joyntly and Severally to be made and Levied for the Use of Somerset County if default be made in the Condition hereunder written The Condition of the above of the above Recognizance is Such that if the above bounden James Smith do and Shall from time to time and at all times hereafter acquitt discharge and Save harmless as well the Justices of Somerset County aforesaid and their Successors for the time being as also the Inhabitants of the Said County from all Costs Charges and troubles whatsoever for or by reason of the birth maintainance Nourishment and bringeth up of the Said Child and of and from all Other Suites Charges troubles and demands whatsoever touching or Concerning of the Same then this Obligation to be Void and of None Effect Otherwise to Stand & remain in full force and Virtue in Law &c William Evans of Somerset County Comes here into Court and prays that his appearance may be Recorded to Save himselfe and Security from a Certain Recognizance Entered into for his good behaviour and appearance at this Court thereupon the Said William Evans appearance is Recorded and he and his Security accordingly discharged whereupon the Said William Evans is ordered to Give Security for the payment of the Severall Officers their fees due by Occasion of the premisses &.c John Pope appears according to his Recognizance Entered into for his Good behaviour and appearance at this Court and is discharged &c John Riggin Jun.r appears accord^ing^ to his Recognizance and is discharged paying the Severall Officers their fees Samuel Riggin appears according to his Recognizance and is discharged he and his Securitys paying of the Severall Officers their fees &c |
