of Land to him the said John Williams his heirs and assigns Forever the said
Percell of Land to begin at a new Marked Red oak near John Puttes Line
from thence runing west the breadth of that Tract Called Barren Lott and
thence Westerly to the Extent of the tract Called Hendersons Second Choice
Includeing all that Land that Lyeth between the said Cross Line and the
river in both tracts To have and to hold the Same unto him the said
John Williams his heirs and assigns forever so that if he the said Francis
Henderson doth fully faithfully and fairly perform whatt is above
Written According to the true Intent and Meaning hereof and Ever warrant
and Defend the said parcell of Land from all manner of person or persons
whatsoever then this present obligation to be Void of none Effect otherways
to Stand and remain in full force power and Virtue in Law
Which being read and heard the said Francis Henderson Says that the
aforesd Thomas Lambden his Action aforesd thereof against him to have
and Maintain ought not because he Says that he the said Francis hath
Well Truly Keept fulfiled and performed all and Singular the Covenents
Grants Articles and Agreements in the Condition aforesd Specified on the
Part and behalfe of him the said Francis to be observed performed fulfilled
and Keep and this he is ready to Verify  Wherefore he prays Judgment if
the aforesd Thom.s Lambden his Action afd against him to have and
Maintain ought &c

And the said Thomas Saith that he by any thing prealledged by the
said Francis in his plea aforesd from having his Accon aforesd against him
the said Francis to be barred ought not Because Protesting that the aforesd
Francis hath not Keept fulfilled and performed any the Covena^n^ts Grants
artiolls and agreements in the Condition of the said obligation Specified on
the part and behalf of him the said Francis to be observed fulfilled pformed
and kept as the said Francis above in his plea hath alledged for plea the
said Thom.s saith that after the making of the writing obligatory afd and
before the day of the Impetration of the Originall Writt of him the said
Thomas against him the said Francis Viz.t on the Seventeenth day of
June Ann Dom Seventeen hundred and thirty at Somrset County within
the Jurisdiction of this Court he the said Francis did refuse upon Demand
to him made then and there by the said Thomas to Lay out and make
over and Confirm to him the said Thom.s a good Sure and Indefeazable
                                                                                                 (Estate)
