121 Attachment according to act of assembly &.c whereupon for that it seems to the Court here that the Said Hannah hath Complyed with the Law as allledged Therefore it is Considered that the afd Hannah Waldron admrx as afd Recover against the Said John Harristoy Seventy two pounds ^& Six pence Curr.t money of Maryland being of the Value of One hundred forty four pounds one Shilling Currant money of the Massakusitts bay her debt aforesaid as also her Costs and damages to the Same Hannah her of 318 her assent by the Court ^here^ adjudged by way ot attachment against the Goods Chattells rights or Creditts of the said John Harristoy according to act of assembly in Such Case made and provided &c
that he render unto him twenty Eight pounds Currant money of Maryland which to him he Owes and Unjustly detains &c And whereupon the said Thomas by Francis Allen his Attorney saith that Whereas the said Francis Henderson the twenty first day of Novemb.r Seventeen hundred and twenty two at Somrset County aforesd within the Jur of this Court by his Certain Writing obligatory which the said Thom.s with the Seal of the said Francis Henderson Signed here into Court brings the date Whereof is the Same day and Year did acknowledge himself to be bound unto the afd John Williamson in the aforesaid twenty Eight pounds Currant money of Maryland aforesd to be paid unto the said John when he Should be thereto required Which said John Williamson on the twenty ninth Day of Aprill ann Dom seventeen hundred and twenty Nine ^at Somerset County^ within the Jur of this Court did assign unto the afd W.m Booth all his Title and Intrest to the said Obligation the Condition in the said obligation then remaining unperformed which said William Booth on the twenty Eighth day of April Seventeen hundred and thirty at Somrset County aforesd within the Jurisdiction aforesd did assigne unto the afd Thom.s all his right Title and Intrest of in and unto the said obligation the Condition of the Same Still Remaining unperformed of which Said Severall assignm.ts the said Francis Hender^son^ on the Fifteenth day of June ann Dom Seventeen hundred and thirty at Somrset County aforesd within the Jurisdiction aforesd by the hands of the Said Thomas Lambden had notice by reason whereof as also by force and Virtue of an act of assembly of this Province now in force in Such Case made and provided the said Francis Henderson became Lyable to pay unto the said Thom.s Lambden the aforesd twenty Eight pounds Money afd yett the said Francis Henderson tho' often required the said twenty ^Eight^ Pounds to the said Thom.s hath not rendred but the Same to him hitherto to render hath Denyed and Still doth Deny and Unjustly Detain to the Damage of the (said) |
