121 Waldron Late of Marblehead marriner dec.d at the time of his death of a plea that he render unto her the Sum of One hundred and forty four pounds One Shiling Currant money of the province of the Massakusetts Bay of the Value of seventy two pounds and Six pence Currant Money of Maryland which from her he unjustly detaines &.c and that thereof he should not fail &c And the Said Hannah Waldron by Levin Gale her attorney declared against the said John Harristoy in the plea aforesaid as followeth vizt Somerset County ss John Harristoy late of Somerset County merchant Otherwise Called John Harristoy of Boston in the County of Sufolk merch.t was Sumoned to answer unto Hannah Waldron administratrix of the Goods and Chattells which belonged to Joseph Waldron late of Marble Head Marriner dec.d at the time of his death of a plea that he render unto her the sum of one hundred and forty four pounds One Shilling Currant money of the province of the Mass.a Bay of the Value of seventy two pounds and six pence Curr.t money of Maryland which from her he unjustly detaines &c And Whereupon the same Hanah by Levin Gale her attorney saith that whereas the said Hannah as admr as aforesd the twenty seventh day of October one thousand Seven hundred and thirty before his Majestys Superiour Court at Salem with^in^ and for the County of Essex in the province of the Massakusetts Bay by the Consideration of the said Court did recover against the said John Haristoy the sum of one Hundred ^and forty four^ pounds ^one Shilling^ Currant money as aforesd of the Value of seventy two pounds and six pence Currant money of maryland Whereof the said John Haristoy if Convict as by the Records and process of the Same Court yet in the same Remaining appears which said Judgment yet remins in full force unsatisfied unreversed yet the afd John Haristoy tho' often thereto required the afd sum of one hundred and forty four pounds one Shilling Currant money as aforesd of the Value of Seventy two pounds and Six pence Currant money of Maryland unto the said Hanah hath not rendred but the same John the Same Hitherto to render hath Denyed and Still doth deny and Unjustly Detain Whereby the Same Hannah Says she is worse and hath Damage to the Value of Ninty Pounds Currant money of maryland and thereof she brings this Suit &.c and the said Hannah brings hereinto Court the Letters of Adm.rs aforesd &.c Levin Gale P Que pledg Jno Doe Rich.d Roe Att which Said third tuesday of August to witt the Seventeenth day of the Same month Anno Dom One thousand Seven hundred and thirty one being the day of the Return of the said Writt Cometh the Said Hannah Waldron by her attorney aforesaid and the Sher of Somerset County to whom the foregoeing writt was directed ^likewise^ Comes and makes return thereof to the Court here Endorsed in these words following vizt Non est Inventus short note Left P John Purnall sher Whereupon the Said Hannah Waldron by her attorney afd prays that for as much as she has Complyed with the Law in order to an attachment she may have Judgmt against the Said John Harristoy for her debt afd by way of attachment |
