1731 120 Colony of Vergenia were sumoned to answere unto John Shapleigh of a plea that they Render unto him one hundred pounds Currant money of Vergenia of the Value of one hundred and ten pounds Currant money of Maryland which to him they owe and Unjustly Detaine &.c And whereupon the same John Shapleigh by Levin Gale his attorney saith that whereas the afd William Wye and W.m Wye Jun.r the Seventh day of Septemb.r Ann Dom one thousand seven hundred and twenty Eight at Somrset County within the Jur of this Court by their Certain Writting obligatory Granted them selves to be held and Firmly Indebted unto the aforesd John in the aforesd one hundred pound Currant money of Vergenia to be paid the said John When afterwards they Should be thereunto Requested Yett the aforesd W.m Wye and W.m Wye Jun.r altho' often thereto requested the aforesd one hundred pounds unto the Same John Shapleigh hath not Rendred but the said W.m Wye and W.m Wye Jun.r the same to render hath Denyed and Still Doth deny and Unjustly Detain Whereby the Same John Shapleigh says he is worse and hath Damage to the Value of fifty Pounds and thereof he brings this Suit &.c and the said John Shapleigh brings here into Court the Writing Obligatory afd wch &.a Levin Gale P Qur Pledges J Doe R Roe And the aforesaid William Wye in his Own proper person Comes and defends the force and Injury when &.c and Says that he Cannot Gainsay the action aforesaid of the afd John Shapleigh nor Can he Say but that the writing Obligatory aforesaid is the deed of him the Same William nor but that he Owes the Same John the afd Sum of One hundred pounds Currt money of Vergenia of the Value of One hundred and ten pounds Curr.t money of Maryland in manner and form as the aforesaid John Shapleigh above against him hath declared &.c Therefore it is Considered that the afd John Shapleigh Recover against the aforesaid William Wye One hundred pounds Currant Money of Vergenia of the Value of One hundred and ten pounds Currant money of Maryland his debt aforesaid And his damages by Occasion of the detaining of the Same debt to 342 three hundred and forty two pounds of tobacco to the Same of his assent by the Court here adjudged and the aforesaid William in mercy &.c
of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of august then next to answer unto Hannah Waldron administrax of the Goods and Chattells which belonged to Joseph Waldron |
