    August Court               1731                 120

    Money and one hundred and seventy Pounds of Tobacco which sum was
    Recovered by the said John Caldwell against the said Thom.s Duncan on this
    Seventeenth day of August one thousand Seven hundred and thirty one
    before me the Subscriber the said Fourteen Shillings and Nine pence and
    one hundred and Seventy Pounds of Tobacco to be Levied of Your bodys
    Goods and Chattles Lands and Tenements for the Use of the said John
    Caldwell in Case the said Tho.s Duncan shall not pay and satisfie the
    same John Caldwell the said Fourteen Shill.s and Nine pence and on hundred
    and seventy Pounds of Tobacco as aforesd Recovered against him
    which the Additionall Costs thereon on the tenth day of February Next

 Command was Given to the Sher of Somerset County that he Should take William
Wye Late of Somerset County Clerk and William Wye Late of Somerset County Marriner
Otherwise Called William Wye and William Wye Jun.r of the County of North thumberland
                         and parish of S.t Stevens of the Coloney of Vergenia if they Should be found in his bailywick
and them Should Safe keep so that he might have their bodys before Our Justices of his Lordships County
Court of Somerset to be held at dividing Creek the third tuesday of June then next to answer unto John Shapleigh
of a plea that they Render unto him One hundred pounds Curr.t money of Vergenia of the Value of One hundred
and ten pounds Curr.t money of Maryland which to him they Owe and Unjustly detain &.c and that thereof
they Should not fail &.c

    Att which Said third tuesday of June to witt the fifteenth day of the Same month anno Dom One thousand
Seven hundred and thirty One being the day of the Return of the Said Writt Cometh the Said John
Shapleigh by ^by Levin Gale^ his attorney aforesaid and the Sher of Somerset County to whom the foregoeing writt was
directed Comes and makes return thereof to the Court here Endorsed viz.t  Cepi Corpus as to W.m Wye Senr

    Whereupon the Said Sher altho' Solemnly Called brings not in the body of the Said William Wye
sen.r according to the return of his Writt in the plea aforesaid   thereupon at the prayer of the said
Sher days is by the Court here Given him untill next Court to bring in the Said William Wye to answer
unto the writt afd &c   And ye same day is Given to the afd plft here also

Att which Said next Court to witt the Seventeenth day of august Anno Dom One thousand Seven
hundred and thirty One Came againe the Said John Shapleigh by his attorney afd as the afd W.m
Wye in his proper person and whereupon the Said John declared against the Said William in
the plea aforesaid as followeth vizt   Somerset ss  William Wye Late of Somerset County Clerk
and W.m Wye late of Somrset Marriner otherwise Called W.m Wye and W.m
Wye Jun.r of the County of Northumberland and parish of S.t Stevens of the
