119 and fraudulently Intending him the Same James in that part Craftilly and Subtilly to defraud and deceive he the aforesaid Benjamin the aforesaid Sum of Eleven pounds Seventeen Shillings and Seven pence nor any part thereof to the Said James hath paid or him for it in anywise Contented altho' the Said Benj.a afterwards to witt the Same day and Year afd at the County afd and within the afd Jurisdiction was thereto requested by the Same James ^but^ to the Said Benjamin the Same to doe hath altogeth refused and still doth refuse whereby the Same James says he is worse and hath damage to the value of twenty pounds Like money and thereof he brings this Suite L Gale P Quer Pledges &.c John Doe R Roe And the aforesaid Benjamin Bowtle by francis allen his attorney Comes and defends the force and Injury when &c And whereupon the dispute in this action is by the Court and Consent of the parties afd Referred to James Mackmorie Thomas Humphrys and Joseph Venables ^of Somerset County Gent^ or any two of them according to the Statute and their award or any two of their awards to be returned to next ^Court^ and Judgm.t to be Given thereon &.c Att which Said next Court to witt the Seventeenth day of August Ann Dom One thousand Seven hundred and thirty one Came againe as well the afd James Ryding as the aforesaid Benj.a Bowtle by their attorneys aforesaid and Likewise the afd James Mackmorie, Thomas Humphry & Joseph Venables the persons mentioned in the afd rule of Referrence ^afd Comes^ and makes Return of their award in the premises as followeth vizt By vertue of a Commission hereunto annexed directed to us the Subscribers bearing date the Eighteenth day of June ann.o Dom 1731 to State peruse and Examine papers and all accounts Betwen James Ryding plft duely heard the allegations of Each party we find that Eleven pounds Seventeen Shillings and Seven pence Cash is the Ballance due unto the Said James Ryding from Benj.a Bowtle Wittness Our hands & Seales this fifth day of Aug.t 1731 James MccMorie (seal) Thos Humphrys (seal) Jos: Venables (Seal) which being read and heard Therefore it is Considered that the afd James Ryding Recover against the afd Benj.a Bowtle his damages afd to the afd Eleven pounds Seventeen Shillings and Seven 232 pence in Cash by the arbitrators afd in form afd found as also two hundred and thirty Two pounds of tobacco for his Costs and CHarges to the SAme James at his request by the Court hereof his assent adjudged and ye afd deft in mercy &.c Whereas there was an order made in August Court Last to M.r David Willson M.r W.m Turpin M.r John Watters and M.r Jefery Long for the Laying out a Road down the midle of the Neck between Back Creek and Annamessex &.c And for as much as the four persons appointed aforesd Could not agree thereupon it is ordered that M.r Robert King, M.r Tho.s Williams and M.r Tho.s Dixon or any two of them meet at a Certain time by them to be appointed in the said neck and Inspect as well the old roads in the said Neck as the aforesd New road and upon their Inspection of the the said roads to Lay out and order which if (the) |
