1731 118 his Costs and damages Sustained by Occasion of the detaining of the Same debt &c Therefore it is Considered that the aforesaid John Atkinson Recover against the aforesaid Tobias Pepper two thousand five hundred and twelve pounds of Good porke part of his debt aforesaid as also his damages by Occasion of the detaining of the same debt to three hundred and 307 Seven pounds of tobacco to the Same John of his assent by the Court here adjudged and the aforesaid deft in mercy &.c
upon the Case &.c and that thereof he Should not fail &.c Att which Said third tuesday of June to witt the fifteenth day of the Same month Ann Dom One thousand Seven hundred and thirty One being the day of the return of the Said Writt Cometh the Said John Bishop by James Shirley his attorney and the Sherr of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words viz.t Cepi Corpus P John Purnall sher And the Said Isaiah Bredall by Francis Allen his attorney Comes and defends the force and Injury when &.c and prayes Cometh as well the afd John Bishop as the afd Isaiah Bredall by their attorneys aforesaid and the afd John Bishop then and there his writt aforesaid against the afd Isaiah Bredall did not prosecute with Effect but Voluntarily permitted his Suit to be discontinued Therefore afterwards to witt the Same day and place by discretion of the Justices 154 here were adjudged the Same Isaiah One hundred & fifty four pounds of tobacco for his Costs & Charges by him about his defence in that part Sustained according to the form of the Statute in Such manner of Case thereof Lately made and provided and that the afd John be in mercy and that the afd Isaiah have thereof Ex.n &c
County within the Jurisdiction of this Court was Indebted unto the Same James Ryding in the Sum of Eleven pounds Seventeen Shillings and Seven pence Currant money of Maryland for the Like Sum at his Especiall Instance and Request before that time for his Use Laid Out and Expended and so thereof being Indebted the Said Benjamin in Consideration thereof afterwards to witt the Same day and Year aforesaid at the County aforesaid and within the aforesaid Jurisdiction upon himselfe assumed and to the Said James then and there faithfully did promisse that when afterward he should be thereunto requested he the aforesaid Sum of Eleven pounds Seventeen Shillings and Seven pence to the Same James would well & faithfully Content and pay nevertheless the Said Benjamin his promise and assumption afd in form afd made Little regarding but plotting and |
