118 Lindow Shall be therein Convict that then he the Said James Lindow Shall pay the Condemnation of the Court thereupon or Render his body to the Custody of the Sher of Somerset County in Satisfaction thereof or that they the Said Nathaniel Horsey ^& Will.m Jones^ will doe it for him &c thereupon the Said James Lindow by Levin Gale & William Bechkingham his attorneys appears and Imparles till next Court &c
Shipham at the prayer of the said Joseph Jones by his attorney aforesaid the Said William Shipham is adjudged to Give Speciall Bail to the action afd thereupon a Certain James Timmons and Aaron Timmons both of Somerset County planters present herein Court undertakes for the Said William Shipham that in Case the Said Joseph Jones shall Recover Judgment in the plea aforesaid against the Said William Shipham or that the Said William Shipham Shall be therein Convict that then he the Said William Shipham shall pay the Condemnation of the Court thereupon or render his body to the Custody of the Sher of Somerset County in Satisfaction thereof or that they the James Timmons and Aaron Timmons will do it for him thereupon the Said William Shipham by Levin Gale his attorney appears and Imparles till next Court &.c
And Whereupon the said John by ^Francis^ Allen his attorney saith that Whereas the said Tobias the sixth day of April Ann Dom Seventeen hundred and twenty Seven at the County of Somrset aforesd within the Jur of this Court by his Certain Writing or bill obligatory which the said John with the seal of the said Tobias Signed here into Court brings the date Whereof is the same day and Year did bind himselfe his heirs Ex.rs & Adm.rs to pay or Cause to be paid unto the said John the aforesd three thousand pounds of porke to be Delivered at snow hill by the Last day of December Next Ensuing after the date of the said Bill Yett the said Tobias tho' often required the said three thousand pounds of Good Pork to the said John at the place aforesd according to the [illegible] of the said Bill hath not rendred but the same to him hitherto to render hath Denyed and still doth Deny and Unjustly Detain to the Damage of the said John of five thousand pounds of Tobacco and thereupon he brings Suit &.a F Allen P Qrte Pledgs de P8 Jno Doe R Roe And the Said Tobias Pepper in his proper person Comes and defends the force & Injury when &.c and Says that he Cannot Gainsay the action afd John Atkinson nor Can he Say but that the Bill or writing Obligatory afd is his deed and that ^part of^ the debt therein mentioned is Yet due & unsatisfied wherefore ye Said prays Judgmt for his debt afd and his |
