And the aforesaid Philip Harris in his own proper person Cometh and defendeth the force and injury when &.c and Says that he
Cannot deny the action aforesaid of the aforesaid John nor but that he did assume upon himselfe in manner and form as the
aforesaid John above against him hath Complained and as to the damages of the Same John by him by Occasion of the premises
in that part Sustained the Same Philip Says and Confeseth that the aforesaid John has Sustained damages by
Occasion of the premisses further than his Costs and Charges by him about his Suit in that part apposed to four pds
Seventeen Shillings Curr.t money and not more and because the aforesaid John denyes not this but the Same allegation
Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges aforesd
to him adjudged &c
                                     Therefore by Consent of the parties aforesaid it is Considered that the afd John Rider recover
against the aforesaid Philip Harris his damages aforesaid to the afd four pounds Seventeen Shillings Curr.t money by
207   the Same Philip in form aforesaid Confessed as also Two hundred and Seven                                 pounds of tob.o
for his Costs and Charges aforesaid to the Same John at his request by the Court here and Consent of the parties afd
adjudged which Certain damages in the whole do amount to four pounds Seventeen Shillings Curr.t money and Two hundred
and Seven                         pounds of tobacco and the aforesaid Philip in mercy &c

 This being an action of trespass upon the Case &.a wherein the Sher of Somerset
County to whom the writt in the Same action was directed Comes and makes Return
thereof to the Court here Endorsed in these words Cepi Corpus and Languidus P Jno Purnall she
Whereupon at the prayer of the afd Richard Bywates by francis Allen his attorney prays his Lordships writt of
duces tecum thereof against the afd Evan Davis to the Sher of Somerset County directed to have the Said Evan
Davis hereat this Court whether he ^be^ sick or well &.c and afterwards in the Same Court Came the Said Evan Davis
in his proper person   and thereupon the Said Evan Davis at the prayer of the plfts ^attorney^ afd is adjudged to
Give Speciall Bail to the action aforesaid  Thereupon Thomas Hearn of Somerset COunty planter present
herein Court undertakes for the Said Evan Davis that if in Case the Said Richard Bywaters shall recover Judg.t
against the Said Evan Davis or that the Said Evan Davis shall be therein Convict that then he the Said
Evan Davis Shall pay the Condemnation of the Court thereupon or render his body to the Custody of
the Sher of Somerset County in Satisfaction thereof or that he the Said Thos Hearn will do it for him
thereupon the Said Evan Davis by Levin Gale his attorney appears & Imparls ^un^till next Court &c

John Stewart Shall recover Judgmt in the plea afd against the Said James Lindow or that the Said James
