111 Towards all his said Lordship Good people then the above recognizance to be Void and of None Effect otherwise &a
that W.m Horsey of Somrset County Planter the tenth day of July and Year aforesaid at the County afd and within the Jurisdiction of this Court with force and Armes &.a in and upon a Certain Joseph Hardin in the peace of God and the Lord proprietary then and there being an assault did make and him did beat wound and Evill Entreat so that of his Life it was despaired and Other harms to him then and there did doe to his Great damage and against the peace of the Right honrble the Lord proprietary his Good Rule and Government whereof the Same Levin for the Said Lord proprietary prays advisement of the Court in &a Levin Gale P Dom propry whereupon the Said William Horsey in his Own proper person appears and thereupon the Said William Horsey is Instantly demanded how he would acquitt himselfe of the premisses afd above upon him Imposed submitts to the Court with a protestation of his Innocency and because he will not plead with the Lord proprietary he putts himselfe upon the favour of the Court &c whereupon all and Singular the premisses by the Court here being seen heard and fully understood &c Wherefore it is Considered by the Court here that the afd William Horsey pay to his Said Lordship the right honrble the Lord proprietary five hundred pounds of tobacco for his fine by Occasion of the premises aforesaid above upon him Imposed and that the Said William Horsey be taken to satisfie his Said Lordship of the fine aforesaid &.c whereupon the Said William Horsey is ordered to Give Recognizance with two Securitys for his Good behaviour and appearance at Novem Court next &c Whereupon the Said William Horsey with Nathaniel Horsey and James Willson his Securitys both all present herein Court acknowledged themselves to Owe and Stand Justly Indebted unto his Said Lordship the Right honrble the Lord proprietary that is to Say the Said William Horsey in twenty pounds Ster Good and Lawfull money of England and the Said Nathaniel Horsey and James Willson in ten pounds Sterling Good and Lawfull money of England of their Severall Goods and Chattells Lands and tenements to be made and Levied for the use of his Said Lordship his heirs and Successors if default be made in the Condition hereunder written The Condition of the above Recognizance is Such that if the above bounden William Horsey do and Shall make his psonall appearance before the Justices of his Lordships County Court of Somrset to be held at Dividing Creek the third tuesday of November Next and answere unto his said Lordship Concerning all Such Matters and things as Shall be then and there objected against him on his Said Lordships behalfe and Stand and abide the Judgment |
