1731 110 who being Called Came to witt Edmond Hough Ambross Willett, John Tull Samuel Hopkins Jun.r Hutton Hill John Holland, John Pitts Wm Smith, Robert Hall Wm Broughton Wm Porter and James Nearne who being duly Elected tryed and Sworn to Say the truth in the premisses upon their Oath do Say that the afd Thomas Duncan is not Guilty of the felony in the Indictmt afd above Specified in manner and form as by the Indictment afd above against him ^is^ Supposed Whereupon all and Singular the premisses by the Court here being Seen heard and fully understood Wherefore it is Considered by the Court here that the afd Thomas Duncan be quiet and goe thereof without day &c wherefore it is ordered by the Court here that the afd Thomas Duncan Give Recognizance in thirty pounds Ster with two Securitys in fifteen pounds Each for the Said Thomas Duncans Good behaviour and appearance at november Court Next &c Whereupon the Said Thomas Duncan with Patrick Kersie and Joseph Jones his Securitys all present here in Court acknowledged themselves to Stand Justly Indebted unto his Lordship the Lord proprietary his heirs and Successors in manner and form following that is to say the afd Thomas Duncan in thirty pounds Sterling and the afd Patrick Kersie and Jos: Jones in fifteen pounds Sterling Each of their Goods and Chattells Lands or tenements seperately to be made and Levied for the use of his Said Lordship his heirs and Successors if default be made in the Condition hereunder written The Condition of the above Recognizance is Such that if the above bounden Thomas Duncan do and Shall make his personall Appearance before the Justices of his Said Lordships County Court of Somerset to be held at dividing Creek the third tuesday of November to and unto his Said Lordship Concerning all Such matters and things as Shall be then and there Objected against him on his Said Lordships behalfe and Stand and abide the Judgmt of the Court thereupon and do not depart the Same Court without Lycence thereof and in the meane time to be of the beheaviour to all his Lordships Good people then the above Recognizance to be void and of None Effect Otherwise &c Likewise the said Thos Duncan is ordered to Give Security for the Severall Officers fees due by Occasion of the premisses afd thereupon the afd Jos Jones & Pat Kersey present as before undertakes for the Said Thos Duncan to pay the Severall officers fees due by Occasion of ye premisses afd
persons and acknowledged themselves to Owe to his Lordship the right honrble the Lord proprietary that is to Say the Said John Riggin in five pounds Sterling and the afd Teague Riggin in five pounds Ster of their Severall Goods and Chattells Lands and tenements to the Use of his Said Lordship his heirs and Successors if default be made in the Condition hereunder written The Condition of the above Recognizance is Such that if the above bounden John Riggin do and shall make his personall appearance before the Justices of His Lordship County Court of Somerset to be held at dividing Creek the third tuesday of November Next and answer unto his Said Lordship Concerning all such |
