109 whereupon the Said Sher altho' Solemnly Called brings not in the body of the Said Alexander Gordon according to the return of his writt afd but made default &.c Wherefore at the prayer of Levin Gale Esq.r who for his Said Lordships in this behalfe prosecutes the Sher of Somerset County to witt John Purnall is americed ^by the Court here^ unto his Said Lordship five hundred pounds of tobacco for his default afd as also as much tobacco as will Satisfie unto their Severall Officers their Fees due by Occasion of the premisses aforesaid &c
Thereupon Command was Given to the Sher of Somerset County that he should take the Said Southy Whittington if &.c to answer &.c And afterwards in the Same Court Came the Said Southy Whittington in his proper person and whereupon Levin Gale Esq.r who for his Said Lordship in this behalfe prosecutes by Judgm.t of the Court freely Saith that he will not against the Said Southy Whittington further prosecute on the presentment afd by Reason of the Insufficiency thereof &.c Therefore it is Considered that the presentment afd be quashed and that the afd Southy Whittington be thereof quiet and Goe thereof without day &.c
thirty One at Somerset County aforesaid and within the Jurisdiction of this Court with force and armes One Bible of the Value of one Shillings ^Currant^ Like money and One Gold Ring of the Value of ten Shillings Like money of of the proper Goods and Chattells of a Certain Mary Caldwell of the Same County Spinster then and there being found then and there feloniously did take Steal and bear away against the Peace of the Said Lord proprietary his Good rule and Government and Contrary to the form of the act of assembly in that Case made and provided &.c Levin Gale Cl Indictments Testes And.w Rathbourn, Joseph Leonard, Joshua Caldwell, Thomas Caton and Brent Nuttall On the backside of the foregoeing bill of Indictment it was thus Endorsed viz.t Billa Vera Nicholas Fountain Foreman And afterwards in the Same Court Came the Said Thomas Duncan under Custody of the Sher of the County afd in whose Custody before that time was Committed for the Cause afd and being by the Said sher Lett to the barr is Instantly demanded how he would acquitt himselfe of the felony in the Indictment aforesaid above upon him Imposed thereupon the said Thomas Duncan Says ^that of the felony of^ that he is not thereof ^Guilty^ and thereof for tryall he putts himselfe upon the Country and Levin Gale Esq.r who for his Said Lordship in this behalfe prosecutes in Like manner Thereupon Command is Given to the Sher of Somerset County that Immediately he Should Cause to Come thereof the Jury before the Justices of his Lordships County Court of Somerset here &c by whom &.c who neither &.c
