the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of march next to answer unto Thomas Nathaniel Williams of a plea of trespass upon the Case &c and that thereof he Should not fail &c Att which said third tuesday of march to witt the Seventeenth day of the Same month One thousand Seven hundred and thirty being the day of the return of the Said Writt Cometh the Said Thomas Nathaniel Williams in his proper person and the Sher of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following viz.t Cepi Corpus P John Purnall sher And the Said John Williams by Francis Allen his attorney Comes and defends the force and Injury when &.c and prayed Leave thereof to Imparle here unto untill the next Court and he had it and the Same day is Given to the aforesaid Thomas Here also &c Att which Said next Court to witt the fifteenth day of June ann.o Dom One thousand Seven hundred and thirty One Came again the Said John Williams by his attorney aforesaid and offers himselfe against the Said Thomas Nathaniel Williams in the plea afd but the Said Thomas Nathaniel Williams altho' Solemnly Called Came not but makes default nor is his writt aforesaid further prosecuted Therefore it is Considered that the aforesaid Thomas Nathaniel Williams and his pledges of prosecuting be in mercy and that the afd John Williams Goe thereof without day also it is Considered that the aforesaid John Williams Recover against the afd Thomas Nathaniel Williams his damages by Occasion of the premises 158 to One hundred and fifty Eight pounds of tobacco to the Same John by discretion of the Justices here at his Request for his Costs and Charges in that part Sustained according to the form of the Statute &.c by the Court here adjudged &c Ordered by the Court that Edward Adams pay unto Edmond Fitzgerrell Ninty pounds of tobacco it being due unto him for his ^wifes^ attendance three days as an evidence on behalfe of the Said Edward Adams against Abra: Ingram Ing he having made Oath to the Same &c ordered by the Court that William Holland pay unto Benj.a Holland and John Brittingham Jun.r Ninty Pounds of Tobacco Each being due unto them for their Attendance three days as an Evidence on behalf of the said W.m Holland against Robert Houston they having made oath to the same &.c ordered by the court that John Harper pay unto William Dure William Stevens and Daniel Towensand three hundred ^and thirty^ pounds of Tobacco Each being due to them for their attandance Eleven Days Each as an Evidence on behalf of the said ^John^ Harper against John Murray they having made oath to the same &.c |
