 Somerset County ss     James Rowland late of Somerset County planter was attached to answer
unto John Magan of a plea of Trespass upon the Case
and Whereupon the said John by Francis Allen his Attorney complains
that whereas the said James the thirtieth day of June
Ann Dom Seventeen hundred and thirty at Somerset County afd within ye
Jur of this Court was Indebted unto the said John in Six pounds tenn
Shillings Currant Money of Maryland for one horse of the price of
Six pounds tenn Shillings by the said James of the said John before
that time had borrowed and Received as by account hereunto annexed
may in Court appear and being so thereof Indebted the said James in
Consideration thereof the day and year afd at Somerset County afd within
the Jurisdiction aforesd upon himself did assume and to the said John
then and there did faithfully promisse that he the said James the said
Six pounds tenn Shillings to the said John when he Should be thereunto
Requested he would well and faithfully pay and Content

    Nevertheless the said James his promise and assumption afd in
forme afd made nothing Regarding but plotting and fraudulently
Intending the said John in that part Crafitlly and Subtilly to deceive
and Defraud the aforesd Six pounds tenn Shillings to the said John altho
the Same to do the said James by the afd John on the afd thirtieth day
of June in the Year afd and often afterwards at Somerset County
afd within the Jur afd he was thereunto Requested hath not paid or
to him for the same in Sort Contented but the same to him hitherto
to pay or in any sort to Content hath Refused and Still doth Refuse &
Deny whereupon he saith he is worse and hath damage to the Value
of thirteen pounds Currant money afd and thereupon he brings Suit &.c

whereupon the Said James Rowland being Called appears and thereupon the Said James Rowland at the prayer of the plft
by his attorney aforesaid is adjudged to Give Speciall bail to the action aforesaid but for want thereof the Said James
Rowland is Committed into the Custody of the Sher of Somerset County thereto remaine &.c the Said Sher to witt John Purnall
Gentleman present herein Court took Charge of the Said James Rowland accordingly thereupon day is Given
unto the James Rowland in Custody as aforesaid untill the next Court and the Same day is Given to the afd plft
here also &.c
                                  Att which Said next Court to witt the fifteenth day of June One thousand Seven hundred
