Creek the third tuesday of November then next to answer John Huntington of a plea of trespass upon the Case &.c And that thereof Should not fail &c att which said third tuesday of November to witt the Seventeenth day of ye Same month one thousand Seven hundred & thirty Came ye Said Jno Huntington by his attorney afd & ye Sher of Somrsett County to whom ye foregoeing writt was directed Likewise Comes & makes return thereof to the County here Endorsed in these words following p.r Cepi Corpus P John Purnall sher And the aforesaid Robert Adkins by James Shirley and Francis Allen his attorneys Comes and defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the next Court and he had it and the same day is Given to the aforesaid John Huntington here also &c Att which Said next Court to witt the Sixteenth day of march Anno Dom One thousand seven hundred & thirty Came againe as well the aforesaid John Huntington as the afd Robert Adkins by their attorneys aforesaid and whereupon the aforesaid Robert Adkins prayed further Leave thereof to Imparle here untill the next Court and he had it and the Same day is Given to the afd John Here also &c Att which Said next Court to witt the Fifteenth day of June Ann.o Dom One thousand Seven hundred & thirty One Came againe the Said Robert Adkins by his attorneys aforesaid and Offers himselfe against the Said John Huntington in the plea afd And because the aforesaid John Huntington within thirty days from this day next following did not declare against the aforesaid Robert Adkins &c Therefore it was adjudged the Same Robert Adkins by the Court here for his Costs and Charges against 165 the Said John Huntington One hundred & sixty five pounds of tobacco according to the form of the Statute &c
of a plea of trespass upon the Case &.c and that thereof he Should not fail &c Att which Said third tuesday of March to witt the Sixteenth day of ^the Same month^ March Ann.o Dom One thousand Seven hundred & thirty being the day of the Return of the Said Writt Cometh the Said Thomas Predix by James Shirley his attorney and the Sher of Somerset County to whom the foregoeing writt was directed ^likewise^ Comes and makes Return thereof to the Court here Endorsed vizt Cepi Corpus P John Purnall sher And the Said John Jerman by Levin Gale and Francis Allen his attorneys Cometh & defendeth the force and Injury when &.c and prayed Leave thereof to Imparle here untill the next Court and he had it and the Same day is Given to the aforesaid Thomas Predix here also &c Att which said next Court to witt fifteenth day of June anno Dom One thousand Seven hundred and thirty One Came againe the said John Jerman by his attorneys afd and offers himselfe against the Said Thomas Predix in the plea afd but the Said Thomas Predix altho' Solemnly Called Cometh not nor is his writt afd further prosecuted &.c Therefore he and his pledges of prosecuting be in mercy and that the plft name pledges &c and that the afd John Jerman Goe thereof without day It is also Considered that the afd John Jerman Recover against the afd Thomas Predix his damages by Occasion of the premisses to one hundred & fifty Eight 158 pounds of tobacco to the Same John by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the Statute &.c by the Court here adjudged &c |
