94 Showed him by Severall of the old Neighbours who told him that was the Second Bounder of Said Land Called friends Denyall and further saith Not Taken before us this 10.th day of Oct 1726 Joseph Venables Tho.s Humphrys Somersett fs Phenix Hall aged about eighty Years being sworn on the Holy Evangelist of almighty God and Laying his Hand on the afd Pine Stump deposeth that about forty years ago Thomas Cox Sen.r Showed this deponient a marked Pine tree where ye said stump now Stands and Told him that pine was the first Bounder of a tract of Land Called freinds denyall the said Cox being at the Survey of s.d Land and this Deponient further saith that he hath seen a marked Pine post standing at ye side of said Stump and Comeing down the said Branch on the south side of s.d branch he brought us to another old pine Stump standing as afd and Laying his hand on said stump deposed that Tho.s Cox Sen.r about the afd Line showed him a Large Growing marked Pine which said stump is still the Remains of said Pine which said Cox told his deponient was ye second bounder of ^said^ freinds denyall and this deponient declears that Long after ye said Pine died and fell down and ^he^ Knew the Stump and saw it Severall times after it was remarked being about ten foot high which said Stump has been Cut Down some time ago but by whome this Deponient Knows not and is now about a foot high Scituate as afd & further Saith not Sworn Before us this 10.th day of october 1726 Jos: Venables Thos Humphyrs March the 5th day 1726/7 These are further to Certifie at the request of said Jn.o Caldwell and by vertue of said Commission we did meet on ye afd ^tracts of^ Land Called Kirkminister and haveing Sumonsed James Smith Jun.r ye said James Smith showed us a tree being a marked white Standing on the South side of a Branch that goes along ye North side of his plantation being a branch that Comes out of ye main head of Wickacomoco river and the said tree being a Little below Said Smiths fence and Clear ground and being by us sworn did declear ye said Tree to be ^both^ a bounder of his own Land & a Bounder of said Caldwell's Land Called Kirk Minister as by his deposition hereunto annexed will appear as Wittness Our hands the day and year afd Jos Venables Somrsett County fs March the 5.th day 1726/7 Thomas Humphrys James Smith aged about forty Eight years being sworn by us the subscribers on ye holy Evangelist of almighty God deposeth and Saith with his hand one said marked white oak that Robert Wallace about twenty four years ago showed him that white oak and told him that it was the first Bounder of a tract of land Called the Camp & that about that time the said Wallace sold this Deponient his part of said tract being one Moiety of the same and this deponient further saith that about twenty years ago Mathew Wallace who was the uptaker of ye Land now in the Possession of Jno Caldwell Called Kirk Minister told this Deponient that his Land Bounded on the Land Called the |
