1728 93 side of the foregoeing Commission it was Thus Endorsed vizt September ye 22 1726 Came Cap.t Joseph Venables, M.r Thomas Humphrys and was sworn on the holy Evangelist of almighty God to Execute the within Commission as the Law Directs Before me John Handy The Execution of the above Commission appears by a Schedule hereunto annexed vizt Maryland fs Somersett County These are to Certifye that we the Subscribers by vertue of his Lordships Commission to us Directed from said County Court to Examine Evidences to ye bounders of three tracts of Land in the possession of Jno Caldwell at whose petition said Commission Issued Beareing date the Seventeenth of august 1726 according to an Act of assembly of s.d Province we did set up our Notes under our hands at Stepney Parrish Church and Chappell dated In aug.t Last past there by giveing Notis According to Law and appointed to meet on said Land ye fifth day of this Instant Octr but being Presented did not Meett on ye s.d Land before the tenth day of s.d Month and then and there did Come Upon ye s.d Lands and no Contending Person appeareing nor any that we Could hereof to appear Tho.s Hearn, Jno rion, Tho.s Hugg Robert Hastins and Phenix Hall being by us summonsed for evidences ye s.d Hearn, rion & Hastins, Brought us to a Large growing white oake standing near ye dwelling house of said John Caldwells in a Clear old feild about forty yards to ye west ard of a buck house by a barn standing in said old feild before said Caldwell's dore which said oak they all swore to being the first Bounder of a tract of Land Called Maiden head as by their Depositions Taken by us Doth appear and walkeing from said Tree a Little into the woods along a Path to the South West that goes to Jn.o Catons ye s.d Hearn, and Rion showed us a sleeping white oake standing by the said path side on the North West side of said Path which said tree ye s.d Hearn and Rion made oath to be the Second Bounder of said Maiden Head as by their Depositions hereunto annexed may ^doth^ appear and Both said Bounders appeareing to be formerly marked was Remarked in Presence of us all and being brought to ye Lands Called freinds Denyall and Kirkminister by Tho.s Hugg & Phenix Hall ye said Hugg and Hall brought us up the North side of a small Branch Called freinds Denyall branch about halfe a Mile above the house where M.r Lackey ^lately^ Lived being opposite to the mouth of a valley that goes out of ye south side of said Branch and there a Little Distance from said Branch they shewed us an old pine Stump and part of a pine post being within two yards to ye East of a marked white Oake which said Stump they both del decleared to be the first Bounder of freinds Denyall and is Like wise ye first bounder of Kirkminister as appears by pattent and being brought by said Hugg and Hall down the said Branch on the South side thereof near to the Mouth thereof opposite to a forke where another branch runs up towards James Smith's they showed us another pine Stump being in the Middle betwixt a marked white oak and a marked red oak ye white oak being to the westward and ye red oak to the Eastward of said Stump they being about ten yards asunder the said Hugg and Hall decleared that said Stump was the Second Bounder of said freinds Denyall as appears by their depositions Taken before us hereunto annexed Given under our hands this 10.th day of Oct 1726 Joseph Venables Thos Humphrys Somersett County fs: Thomas Hearn aged about forty Years being sworn on the holy |
