                            June Court             1728                    92

years agoe yt Tho.s Winder and Andrew Appellston & old Thomas Wilson & severall other of the
old Standers Showed him ye s.d Hickory which was then a groeing tree witht he Marks plain to
be Seen & told this deponant that it was the Bounder of the tract of Land Called Monmoth
then in the Poossession of Tho.s Webb of Virginia & Originally Granted to Jn.o Evens and
further Saith yt about twenty five years agoe being in Company with Daniel Maginey
the S.d Daniel Shewed this Deponant a marked pine at ye Mill Dam & told this Deponant
that when he Bought a part of the Land Called Chelsey of Jn.o Tulley that old
Stephen Tulley run out the same for him and would have run from the said Hickory
it being the first Bounder of of the Land Called Chesley South East according to the
Courses of the pattent but ye S.d pine being the Second bounder Mentioned in ye pattents
of Chesley & further Saith not Taken before us this 16th day of Janry 1727/8

          Somrsett Co.ty fs:  Mary Such aged about fifty five years being         Jn.o Caldwell
Sworn on the Holy Evangelist of almighty God Deposeth & Saith                Tho.s Humphris
that about twenty years agoe old Richd Jefferson told this Deponant            Rob.t Givan
and her husband thats Webbs Marked Hickory stood in such a place and in a Little time
this Deponant then found a Marked Hickory in the Same Place Jefferson told then a
Liveing tree which now Lies rotten in the Place where this Deponant now Stands and
further Saith not.   Taken before us this 16.th day of Janry 1727/8            Jno Caldwell

Somersett fs  Charles absolute Lord and Proprietary of the

provinces of maryland and avalon Lord Baron of Baltemore &c
                      To Joseph Venables, Ebenezer Handy, Thomas Humphrys, John Roach all of
Somersett County Gent.m Greeing Know ye that we have appointed you or any three or two of you
to be Our Commissioners to Examine Evidences on behalfe of a Certain John Caldwell of the County
afd Gent.m in relation to the Bounds of three tracts of Land Lying in the County afd Named as follows
viz.t Maiden head, Kirk Minister and freinds Denyall we therefore require you or any
three or two of you that at some time and place as to you or any three or two of you shall Seem Convenient
you mete on the afd Lands Called Maiden head, Kirk minister and friends Denyall and
there Cause to Come Before you or any three or two ^of^ you all Such Evidences as Shall be to you or any
\three or two of you nominated by ye said Complainant (or Deft if any) and that you Examine them
upon their Corporall Oaths to be by you or any three or two of you administred on the Holy Evangalist
of almighty God in teh presence of the Complainent (or Deft if any) touching the truth or remembrances
of their Knowledge or any thing that may relate to the Cause afd and that reduceing
the severall Depositions into writing you send the same together with this our Commission under
your or any three or two of your hands to us to Our County Court of Somersett with all Convenient
Speed Wittness Samuel Hopkins Chiefe Justice of our said Court &c      On the Back
