92 or remembrances of their Knowledge or anything that may relate to the Cause afd & that reduceing ye Severall Depositions into Writing you send ye same together with this our Commission under your or any three or two of your Hands to us to our Co.ty Co.t of Somrsett with all Conveniant Speed Wittness Sam.l Hopkins Gent.m Chief Justice of our s.d Court &a On the Backside of the foregoing Commission it was thus Endorsed vizt January 16.th 1727/8 Came M.r Jn.o Caldwell & M.r Tho.s Humphris two of ye within Commissioners & was Quallifyed according to Law to Execute ye within Commission Before me John Handy Maryland Somrsett County fs: January the 16.th 1727/8 These are to Certifie that we ye subscribers by vertue of his Lordships Commission to us Directed from the Justices of S.d Co.ty Court to Examine Evidences to ye Bounds of three tracts of Land Called Rose Chelsey & Mummoth part of which Lands is in ye Possession of M.r Christopher Nutter & Will.m More at whose Petition S.d Commission Isshued bearing Date ye twenty fifth day of Novem one thousand Seven hundred & twenty seven according to act of assembly we did sett up our Notifications under our hands att Stepny Church & Chappill & other Publick Places about thirty Dayes before we Mett on Said Land and did Certifie in the Said Notifications that we would Meet on Said Lands on ye Sixteenth day of Jany one thousand seven hundred & twenty Seven Eight & accordingly did Meet on S.d Lands on the S.d Sixteenth day & haveing Sumoned Cap.t Jos: Venables and Mary Souch for Evidences & noe Contending party appearing or any to appear that we heard of we did proceed & being Brought by M.r Nutter & M.r More ye petitioners and by Capt Jos: Venables & Mary Souch to the Northwestside of Quanticoe Creek in S.d Co.ty & in Stepney Parish they shewed us a hickory Stump Standing on ye Eastside of a Small Gutt Close by ye Marshside of S.d Creek & about Sixty five Yards blo belowe a fast Landing Called the Ship Landing and being about Eighty pole belowe Jean Megining's house & opposett to W.m Gilesas house and about five Yards to the Southward of a young Growing hik hickory all parties present agreed to Mark the said Hickory with Sixteen Notches for a remembrance of the S.d Stump & a Mulberry Post Marked with Sixteen Notches was in our Presents Sett Down at ye rute of the afd hickory Cap.t Jos: Venables & Mary Souch Declared to be ye Bounder of M.r Webs Land Called Monmoth as will appear by their Depositions hereunto annexed & the Said Jos: Venables went up the Said Creek about fifty yards above his Millhouse & Shewed us an old pine tree which had old Marks on it to be Seen & declared yt the said pine was as he had been told ye second bounder of ye Land Called Chelsey and yt ye Said Hickory Stump was ye first Bounder of S.d Chesley as appears by Said Venables Deposition hereunto annexed Given under our hands the Day and Year afd Jn.o Caldwell Somrsett Co.ty fs: Cap.t Jos: Venables aged about Sixty years Tho.s Humphris being sworne on holy Evangelist of almighty God deposeth and Rob.t Givan sath saith being at ye afd old Hickory Stump & that about thirty (years) |
