9 Refused and Still doth Refuse to the Damage of the Same Hocken Hull Twenty five pounds Curr.t mony and one hundred and thirty Bushells of Wheat and Thereof he Brings This Suite &.c L Gale P Quer Pledges &.c Jno Doe R Roe Thomas Purnall D.r to Hocken Hull Short P Contra Cr aug.t 10.th To 109 Gall.s Moll.s sold you @ 2/2 11..16..2 By Ball Due 11..16..2 1726 To 109 Gall.s Mollasses sold you for & 68 Bushells wheat Sixty Eight Bushells Wheat And the afd Thomas Purnall by George Dashiell his attorney Comes and defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd plft here also Att which said next Court to witt the twenty first day of March Anno Dom one thousand seven hundred and twenty six Came againe as well the afd Hocken hull short as the afd Thomas Purnall by their attorneys afd and hereupon the the said Thomas Purnall by his said attorney prayed further leave thereof to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd Plft here also Att which said next Court to witt the twentieth day of June anno Dom one thousand seven hundred and twenty Seven Came againe as well the afd Hocken Hull Short as the afd Thomas Purnall by their attorneys afd and hereupon the said Thomas Purnall by his said attorney as before defends the force and Injury when &.c and Saith that he did not assume upon himselfe in manner and form as the Plft above against him hath Complained and of this he putts himselfe upon the Country &.c and the plft in like Manner Thereupon Command is given to the sherr of Somersett County that Immediately he Cause to Come here twelve &.c by whom &.c who neither &.c to Recognize &.c becaus as well &c of which said preceipt the said Sherr to witt Francis Allen Gent Now hereat this Day (to witt) the same day and year Last Mentioned makes Return that he hath here ready twelve &c as by his said Precept he was Commanded and Now here afterwards to witt the same day and year Came as well the afd Hocken Hull short as the afd Thomas Purnall by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt Benja Wailes, Jn.o Donelson, Thomas Peal, James Rownd, Wm Cord, Robert Collier, Thomas Laws, Charles Townsend, Isaac Brittingham, W.m Dixon, Bruffe Broughton and Revell Horsey who being duely Elected tryed and Sworn to say the truth in the premises upon their Oath do say that the afd Thomas Purnall did not assume upon himselfe in manner and form as the afd Hocken Hull short above against him hath Complained &c Therefore it is Considered by the Court here the twentieth day of June anno Dom One thousand |
