8 Laid Out and Expend to thirty Shillings But for that the Justices here as yett are not advised on the rendering their Judgm.t of and upon the premisses and verdict afd day therefore is given to the parties afd to hear thereof their Judgm.t untill the Next Court for that the said Justices as yet &a Att which said Next Court to witt the twentieth day of June anno Dom one thousand seven hundred and twenty Seven Came againe as well the afd Rowland Bevans and Mary his wife as the afd Littleton Townsend by their attorneys afd and whereupon all and singular the premisses being seen heard & mature deliberation ^thereupon^ had it seemeth to the Court here that the afd verdict is Sufficient in the Law for the afd plantiffes to recover against the afd defend.t as much Costs as Damages according to the form of the Statute in Such Case made and provided &c Therefore it is Considered by the Court here that same day and year Last Mentioned that ye afd Rowland Beavens and Mary his wife recover against the afd Littleton Townsend thirty shill their damages afd by the Jurors afd in form afd assesed as also three hundred and sixty pounds of tobacco for to the same Plfts as their Request for their Costs and Charges by the Court here adjudged and ye afd deft in mercy &c
Complaines that whereas the afd Tho.s Purnall the tenth day of Aug.t Anno Dom one thousand Seven hundred and twenty Six at Somersett County afd within the Jurisdiction of this Court was Indebted to the afd Hocken Hull in the Sum of Eleven pounds Sixteen Shillings and two pence Curr.t Mony and Sixty Eight Bushells of wheat as by Acc.t here within Court produced may appear and so thereof being Indebted the Same Thomas in Consideration thereof afterwards to witt the Same day and Year afd at the County afd within ye afd Jurisdiction upon himselfe assumed and to the Same Hocken Hull then and there faithfully promissed that he when afterwards he Should be there^un^to requested he the said Thomas the said Sum of Eleven pounds Sixteen Shiil.s & two pence and Sixty Eight Bushells of wheat to the Same Hocken Hull he would well and faithfully Content and pay Nevertheless the same Thomas his promisse and assumption afd in form afd made Little Regarding but plotting and fraudulently Intending him ye said Hocken Hull in this part Craftilly and Subtilly to defraud and deceive he ye s.d Sum of Eleven pd.s Sixteen shill.s & two pence Curr.t mony & Sixty Eight Bushells of Wheat or any part thereof to ye same Hocken Hull (altho' the said Thomas Afterwards to witt the same day and Year afd at ye County afd within the afd Jurisdiction By the said Hocken Hull was thereto Requested) hath not paid or him for it in any wise Contented but the Same Thomas the Same hitherto to do hath altogether Refused |
