1727 8 Good will not only of her Neigbours but of all other faithfull Subjects of our Lord the King to whome she was Known Nevertheless the afd Littleton not Ignorant of the Premisses but Envying the Hapy Estate & Condition of the Same Mary & Maliciously Intending not only to ruine the good Name fame Creditt & reputation of ye Same Mary & her into Hatred & Contempt among her Neighbours to bring but also to bring the said Mary in Manifest Danger of being Whipt or paying three pd.s or twelve hundred pd.s of Tob.o the tenth Day of June Ann.o Dom one thousand Seven hundred & twenty five at ye Coty afd within ye Jur of this Court these falce feighned & aprobias words & Lyes following unto a Certain Cornelias Bivans a Son of the afd Rowland upon the body of ye afd Mary Lawfully begotten in presence & hearing of Divers faithfull People of ye Co.ty afd did Speak pronounce rehears & with a high Voice Publish viz.t you (the afd Cornellias Speaking to & Meaning) Mother (the afd Mary speaking of & Meaning) is a whore & I (the afd Littleton himselfe Speaking of & Meaning Can prove it Whereas in truth ye same Mary Never a treason felony Burgery theft fornication or adultery or any such Like wicked or base Crime Ever Committed or perpetrated by reason of the Spakeing publishing & uttering of which falce feighned Scandalous & approbias words and Lyes ye Same Mary is not only very Much Hurt & Damnified in her good Name fame Credit & Estimation but is brought though Innocent in Danger of being Whipt or forfeiting three pd.s Cur money or twelve hundred pd.s of Tob.o whereby the same rowland & Mary says they are worse & hath Dam to ye value of sixty pd.s Curr.t money & thereof they bring ^this^ suite &a L Gale P Quer pledges &.a J Doe R Roe And the afd Littleton Townsend by George Dashiel his attorney Comes and Defends the force and Injury when &c and says that he is not guilty of the premisses above Imposed upon him and of this he putts himselfe upon the Country and the plft Likewise Thereupon Command is given to the sherr of Somersett County that Immediately he Cause to Come here twelve &.c by whom &.c who neither &.c to recognize &.c because as well &c of which said preceipt the said Sherr to witt Francis Allen Gent Now hereat to witt the twenty first day of march anno Dom One thousand Seven hundred and twenty Six Comes and makes Return that he hath here ready twelve &.c as by his said preceipt he was Commanded and Now hereafterwards to witt the same day and Year Comes as well the afd Plfts as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt Charles Cottingham, Henry Toadvine, W.m Lane, W.m MccClammey, Isaac Marshall Lewis Disharoon, Edward Beachampt, Moses Driskill, Giddion Tilman, Mathew Purnall, Henry Alexander and Benj.a Houston who being duely Elected tryed and Sworn to Say the truth in the premisses upon their Oath do say that the afd Littleton Townsend is guilty of the premisses as the afd Rowland and Mary above against him hath Complained and do assess the damages of the same Rowland and Mary by occasion of the premisses besides their Costs and Charges in this behalfe (Laid) |
