84 Then next to answer unto Thomas Billin of a plea of trespass upon the Case &.c And that thereof he should not fail &c Att which said third tuesday of March to witt the Ninteenth day of the same Month Anno Dom one thousand Seven hundred and twenty Seven being the day of the return of the said writt Cometh the afd Thomas Billin by his ^attorney^ afd and the Sherr of Somersett County to whom the the foregoeing writt was Directed Likewise Cometh & Maketh Return thereof to the Court here Endorsed in these words folloing vizt Cepi Corpus P me Francis Allen Sherr And the afd Hocken Hull Shorte in his Own Proper person Comes and defends the force and Injury when &.c And thereupon the dispute in this action is by the Court and Consent of the parties afd Refered to John Donnelson and Nicholas Fountain Gent.m according to form of the Statute and Judgm.t to be on their Return as of this Court &c And afterwards in the same Court Came the Said John Donnelson and Nicholas fountain the persons mentioned in the Rule of referrence and makes return of their award in the premisses as followeth viz.t We find by Examination Capt Hocken Hull Short stands Indebted to Capt Thomas Billins two Shillings and Eight Pence halfe penny Jno Donelson Nicholas Fountain Wherefore the damages afd found by the Persons mentioned in the rule of referrence afd being not within the Jurisdiction of this Court to give Judgm.t thereon for the afd Plft Therefore it is Considered by the Court here the Ninteenth day of March Anno Dom One thousand Seven hundred and twenty Seven that the afd Thomas Billin and his pledges of Prosecuting be in mercy and that the Names of his pledges be sought for &.c and that the afd Hocken Hull Short goe thereof without day It is also Considered that the afd Hocken Hull short Recover against the afd Thomas Billins his damages by Occasion of the premisses afd to One 140 hundred & forty pounds of tobacco to the same Hocken Hull short by discretion of the Justices here at his Request for his Costs and Charges in that part Expended according to the form of the statute in Such Case Lately made and Provided by the Court here adjudged &c
