  Andrew Wailes
Command was Given to the Sherr of Somersett County that he Should take
Andrew Wailes Late of Somersett County Mercht if he Should be found in his
bailywick and him Should safe Keep so that he might have his body before
                   the Justices of his Lordships County Court of Somersett to be held at dividing Creek the
third tuesday of March then Next to answer unto Joseph MccClester of a plea of trespass upon the
Case &.c and that thereof he Should not fail &c

          And the afd Joseph MccClester by Levin Gale his attorney Proceeded against the afd Andrew
Wailes in the plea afd as followeth vizt

                                        Sir: Pleas to take Notice that there is an action brought against
you in Somersett County Court by Capt Joseph MccClester which is to recover three thousand
pounds of tobacco which you received for his use and if you do not appear at the next Court
to be held for the County afd and defend the said Suit; attachment will be prayed against your
Estate by                                          Levin Gale P Quer
To M.r And.w Wailes      This
                                                      A Copy of the foregoeing Short note Expressing the Cause of
Action was made and Sent to be Left at the Last place of abode of the afd Deft &.c
                Att which said third tuesday of March to witt the Ninteenth day of the Same month anno
Dom One thousand seven hundred and twenty seven being the day of the Return of the Said
Writt Cometh the said Joseph MccClester by his attorney afd and the Sherr of Somersett County to
whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the
Court here Endorsed in these words viz.t   Non Est Inventus Shorte note deft at the ^defts^ Last Place
of abode         P                                 Francis Allen sher

                            Whereupon the afd Joseph MccClester by his attorney afd Prays that forasmuch
as he hath Complyed with the Law in Order to an attachment he may have Judgm.t against the
said Andrew Wailes for his damages by way of attachm.t according ot act of assembly &.c

          Whereupon for that it Seems to the Court here that the afd Joseph MccClester hath Complyed
with the Law as alledged

                            Therefore it is Considered by the Court here the Ninteenth day of March
Ann.o Dom One thousand Seven hundred and twenty Seven that the afd Joseph MccClester Recover
against the afd Andrew Wailes the Sum of three thousand pounds of tobacco his damages by occasion
275    of  the premisses afd as also all Costs and Charges by the Said Plft Laid Out and Expended
about his Suit by way of attachm.t against the goods Chattells and Creditts of the Said Andrew Wailes
according to act of assembly in Such Case made and provided &c
