apprehended belonged to said Persons & further Saith not      William Brereton

The Commissioners Saw a Cedar Stake Sett Where the Evidences Declared ye live oak
to stand Marked with 16 Notches about the Middle of the Now Clear Plantation
as to the Length but Near the wood on the East side of the said Plantation

    Thomas Brereton aged about forty two years Saith yt a Cedar Post Standing in ye
Woods Near a Swamp is Sett at ye root of a tree being a Stooping White Oak which
Was always Deemed the first Bounder of a piece of Land Called second Choice
as he has Been Informed by old John Persons and Charles Mullin and further
Saith not                                                                              Thomas Brereton

Isaac Noble aged about fifty years Sworn & Saith that he heard old Jn.o Persons
Say the first Bounder of Second choice was the Ugley's tree he Could find in
the Woods he thought Nobody would Make use of itt & Zounds Raymond
had Cutt it Down further Saith not                                    Isaac Noble

There is a Stake of Cedar Standing at the root of the said tree Marked with
Sixteen Notches

Janry ye 29.th 1725/6      The Depositions for Perpetuating ye Bounds of the land

       us the Subscribers being thereto Duely Qualified as Wittness our hands

Co.ty Gent Greeting Know ye that we have appointed your or any
             three or two of you to be our Commissioners to Examine Evidences on Behalfe
of a Certain Robert Ware of the Co.ty afd in relation to ye Bounds of a tract of
Land Containing one hundred & fifty acres Lying in the County afd Called Wover Marsh
We therefore require you or any three or two of you at Some time & place as to you
or any three or two of you shall seem Conveniant you Meet on the afd Land Called
Wover Marsh (you first haveing taken your Oath on the Holy Evangelist of almighty
God according to act of assembly in Such Case made and Provided) & there
Cause to Come before you or any three or two of you all Such Evidences as shall be to
you or any three or two of you Nominated by the said Complainant (or Deft if any) &
that you Examine them upon their Corporall Oaths to be by you or any three or two of
you administred on the Holy Evangelist of almighty God in the presents of the
Complaniant (or Deft if any) touching the truth or remembrances of there Knowledge
or anything that may relate to the Cause afd & that reducing the severall
Depositions into Writing you Send the Same together with this our Commission
under your or any three or two of your hands to us to our Co.ty Court of Somrsett
