1727 80 Standing at his Spring Near the House that was Built by Jn.o Persons & further saith Not that about a hundred yards of he did fall a hickory yt was a line tree & old John Persons asked him why he Cutt down yt tree for it was one of Preslys Line trees and further Saith not Tho.s Brereton Peter Sirman Sen.r aged about fifty four years being Sworn Saith that he was at an old tob.o House with Jn.o Persons who told him that house Stood near ye Line of Peter Presley & ye Deponiant asked him if he Wraught the same Preslys Land & the same Persons told this Deponant yt Presleys Corner tree Stood Near his Spring with the top hanging over itt & he Gave Peter Presley a priviledge in his White Oak Swamp for the use of the said Presley's High Land this Information was about 25 years Past & further Saith not his Peter S: Sirman marke Isaac Noble aged about fifty years being Sworn and Saith that about Nineteen years past he was at the House of Jn.o Persons & Asked him why he did not Exchange Some Land with Will.m Allexander & Persons told him all that Neck was not his one it was Peter Presleys why Said this Deponant doe you Work another mans Ground who answered yes (Blood doe I) and I give him a priviledge in the Woolftrap ridge said he his Bounder Stands by my Spring But this deponant did not Goe to See ye Marks in ye said tree at ye Spring and further Saith not Isaac Noble Geo: Godart aged about thirty Nine years Saith that his father told him yt one of Peter Presley's Bounders stood at Jn.o Persons Spring & that he saw a tree there Plainly Marked about twenty years Past and further Saith that he heard old Jn.o Persons Say that he was to have the Priviledge of what Land Lay above the Branch for the use of timber in the Swamp Called the Woolftrap ridge and further Saith Not George x Godart signum Will.m Hayman aged about fifty Eight being Sworn Saith that about twenty years past he heard old Nicholass Toadvine say that a white oak Standing at Jn.o Persons Spring was one of Peter Presley's Bounder & yt he Marked it or saw it Marked when he was Will.m Breretons Servant & further Saith Not William Hayman Nicholass Toadvine aged about forty Eight years Sworn and Saith yt he heard his father Say that a white Oak Standing by the Spring was one of Presley's Bounders & y.t Presley Line would take Some of Persons old field & further saith not Nicholass X Toadvine Signum By ye Stump of the above tree is fixt a Cedar Stake Marked with Sixteen Notches Tho.s Brereton aged forty two years or there about's being Sworn & Saith that Jn.o Persons told him that a little Distance from his Tob.o House there was a live Oak of of Presleys Bounder & ye Said Persons was angry with his Brother John and this Deponant and Said they had Cutt down the said Bounder for ^a^ Squerill but this Deponant doth Not remember the falling the Said tree it Stood about the Middle of the Plantation to the Length Length but Near ye Woods towards the Swamp & further this Deponant Saith not Tho.s Brereton Will.m Brereton aged about fifty one Years saith that old Jn.o Persons told him Severall times that a little to ye Northwest of an old tob.o House was the line that Divided him & Presley this Deponant asked him why he tended Presleys Land who answered it was for a Priviledge that he gave Presley in ye Swamp Called the Woolftrap ridge for timber which was a peice of Land this Deponant (apprehended) |
