80 of the County afd Gent in relation to the Bounds of two tracts of Land Lying in the County afd the one Called Smiths adventure the Other Second Choice we therefore require you or any three or two of you that at some time & Place as to you or any three or two of you Shall Seem Convenient you Meet on the afd tracts of Land Called Smiths adventure & second Choice & there Cause to Come before you or any three or two of you all such Evidences as Shall be to you or three ^or two^ of you Nominated by the said Complainant & yt you Examine them upon their Corporall Oaths to be by you or any three or two of you administred on the Holy Evangelist of almighty God in the presents of the Complainant afd (& deft if any) touching the truth or remembrance of their Knowledge or anything yt may relate to the Cause afd & that reduceing ye Severall Depositions into Writing you Send ye Same together with this our Commission under your or any three or two of your hand to us our Co.ty Court of Somrsett with all Conveniant Speed Wittness Sam.l Hopkins Gent Chief Justice of our Said Court the Nineteenth day of August in the tenth year of our Dominion &a The following Depositions to the foregoing Commission was thereunto annexed viz.t Somrsett Co.ty fs: Depositions of Wittnesses taken at ye Plantation of Tho.s Gillis at Wiccocomoco Creek in Somrsett County the twenty Ninth day of January Anno Dom one thousand Seven hundred & twenty five six by vertue of a Commission to us Directed out of his Lordships Court ^for^ of Somrsett Co.ty Bearing Date the Nineteenth day of August ann.o Dom one thousand Seven hundred & twenty five for the Examining Evidences for the Perpetuating the Bounds of two tracts of Land ye one Called Smith's adventure the other Second Choice &a Thomas Brereton aged about forty two years be Sworn Saith that his father & old Jn.o Persons Informed him yt by a valie Near where M.r Allex.d Adams house now Stands at a tree that was then Standing that that tree was the Bounder that Divided W.m Brereton & Peter Presly & ye tree being Blowen Down with the Wind was shewed to ye Commissioner & further Saith Not Janry 29.th 1725/6 Tho.s Brereton Att the root of the above tree there was a Cedar Stake fixt marked with four Notches on four sides George Balie aged about Sixty three years be Sworn Saith that forty years past he always heard it reported that at the afd valie ye tree Stood that was ye Divis^i^onall bounder between Will.m Brereton & Peter Presly & further saith not Geo: Balie Thomas Brereton saith on his Oath that the Second Bounder of Smith's adventure was an old field pine Standing Near the place where ye Mill is built as he was Informed by old Jn.o Persons Charles Mullin & his father & further saith not. Tho.s Brereton Att which place is fixt a Cedar Stake Marked with Sixteen Notches William Allexander aged about fifty Six years on his Oath Saith that Jonathan Raymond Informed him yt ye afore Mentioned pine was one of Presleys Bounders and further Saith not Will.m Alexander Thomas Brereton aged about forty two years Saith on his Oath that old John Persons Informed him that one of Petter Presly's Bounders was a Stooping oak (Standing) |
