in that part Craftilly and Subtilly to Defraud & Deceive he the afd sum of Eleven
hundred & sixty six pd.s of Tob.o unto the afd robert in his Lifetime nor the afd Mary
Since his Death whilst She was sole nor the afd James & Mary since the Espousalls between
them Celebrated hath not paid nor any of them for it in anywise Contented although
the Said W.m the Same to doe afterwards to witt the tenth day of May Anno
Dom one thousand Seven hundred & twenty four by the Said Robert in his life time &
the tenth day of May Ann.o Dom one thousand Seven hundred & twenty five by the Same
James & Mary since the death of the afd Robert & the Espousalls between them Celebrated
at Somrsett Co.ty afd within the Jur afd was thereto requested but the said W.m
the same hitherto to Doe hath altogether refused & Still doth refuse Whereby ye
Same James & Mary Say they are worse & hath Dam.s to ye value of two thousand three
Hundred & thirty two pd.s of Tob.o & thereof they bring this suite &.a      And the Same
James & Mary brings here into Court the Letters testamentary afd &.a by which &a

And the afd Will.m Eskridge by George Dashiell his attry Comes & Defends the force
and Injury When &.a & Prays Leave to Imparle here unto untill the Next Court
and he hath it & the Same day is given to the afd James & Mary here also &a

             Att which said Next Court to witt the Ninteenth day of March Anno Dom One thousand Seven hundred
and twenty seven Came againe as well the afd James Martin and Mary his wife Exrx as afd by their attorney
afd as the said William Eskridge in his Own proper person and the said William Saith that he Cannot gainsay
the Plfts their action afd against him brought nor Can he say but that he Owes the afd Plfts the afd
One thousand One hundred and Sixty Six pounds of tob.o as the Plfts above against him have declared and
the Same declaration in all the words before Expressly Confesseth &c

                   Therefore it is Considered by the Court here the Same day and Year Last Mentioned that the
afd James Martin and Mary his wife Executrix as afd Recover against the afd W.m Eskridge One thousand
One hundred and Sixty Six pounds of tobacco their damages afd in form afd Confessed as also the Sum
235   of Two hundred and thirty five               pounds of tobacco for their Costs and Charges by them about
their Suite in that Part Expended by the Court here of their assent adjudged and the afd Deft in Mercy &c
