78 the same day and Year Last Mentioned that the afd Edward Chapman take nothing by his writt and declaration afd but be in mercy for his falce Clamour and that the said Rowland Beavins goe thereof without day &.c And further it is Considered that the afd Rowland Beavins Recover against the afd Edwd Chapman 149 One hundred and forty Nine pounds of tob.o for his Costs and Charges by him about his defence in that Part Expended to the Same Rowland by the Court here of his assent adjudged and that he have thereof Execution &c
one thousand seven hundred & twenty six before Saml Hopkins Gent & his associates then Justices of our said Co.ty Co.t of Somrsett at Dividing Creek & by ye Consideration of ye Same Court recovered ag.t W.m Pepper of alhollows Parrish in ye Co.ty afd Planter as well a Certain Debt of fifteen hundred & Ninteen pounds of tob.o as two hundred and Seventy five pd.s of tob.o which to the same Mary of her assent by our same Court were adjudged for her Costs and Charges Damages which she sustained by occasion of ye detaining of the same debt whereof he is Convict as by ye records and proceedings thereof in Our Court before our Justices at Dividing Creek now remaineth Manifestly appeareth & afterwards ye afd Mary took to her husband a Certain James Martin as by ye Insinuation of ye Same James & Mary in Our Cot before us at dividing Creek we have rec.d Nevertheless Execution of ye Judgm.t afd as yet remaineth to be made & afterwards ye afd William Pepper at alhollows Parrish in ye Co.ty afd made his testam.t & Last will in writing & Constituted Jno Blizard Ex.r of the testamt afd upon himselfe took and the same testam.t had in Lawfull form Proved as on the part of the afd James and Mary in our same Court we have rec.d and because we are willing that those things which in Our Court afd are rightfully done ought to be duly Executed we Command you that by good and Lawfull men of your Bailywick you Make Known unto ye afd Jno Blizard that he be before Our Justices of our Co.ty Co.t of Somrsett to be held at Dividing Creek the third tuesday of Novem Next to shew Cause if any thing for himselfe he hath or Knoweth to say wherefore the afd James and Mary their Execution agt of the debt and damages afd against the afd Jno Blizard to have ought not (of ye goods and Chattells which were of ye afd Wm Pepper at ye time of his death in the hands of ye same Jno Blizard remaining to be administred if so much thereof in his hands he hath) according to the force form & Effect of the recovery afd if to him it shall Seem Expedient and have you then & there the Names of them by by whome you Make Known to him and This Writt Wittness Samuel Hopkins Gent Chiefe Justice of our said Court the Eighteenth day of August in the twelfth year of Our dominion &.c Att which said third tuesday of Novem to witt the twenty first day of the ^same Month^ Anno Dom one thousand Seven hundred and twenty Seven being the day of the return of the said Writt Cometh the afd James Martin and Mary his wife by their attorneys afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and Maketh and Maketh Return thereof to the Court here Endorsed in these Words Wollowing vizt Made Known P Me Francis Allen sherr |
