78 of a plea of trespass upon the Case &a And whereupon the Same Edward by Levin Gale his attry Complaines that whereas the afd Rowland the tenth day of August Anno Dom one thousand Seven hundred & twenty seven at Somrsett County within the Jur of this Court was Indebted to the Same Edward in the Sum of five hundred pounds of Tobo for Work for the Same Rowland by the Same Edward before that time done as by acc.t here within Court Produced may appear & so thereof being Indebted the Said Rowland in Consideration thereof afterwards to witt the same day & year afd at the County afd & within the afd Jur afd upon himselfe assumed & to the Same Edward then & there faithfully Promised that he when afterwards he Should be thereto requested he ye afd Sum of five hundred pounds of tob.o to the Same Edward would well & faithfully Content and Pay Nevertheless the said Rowland his Promise & assumption afd in form afd Made not regarding but plotting and fraudulently Intending him the same Edward in that part Craftilly and Subtilly to Defraud and Deceive the afd Sum of five hundred pounds of tob.o or any part thereof to the Same Edward hath not paid although the same to doe the afd Rowland afterwards viz.t the Same day & year afd at the County afd and & within the afd Jur by the Same Edward was requested but he the Same hitherto to doe hath altogether Refused & Still doth refuse Whereby the Same Edward sayes he is worse & hath Dam.s to the value of Eleven hundred & Ninety pounds of Tob.o & thereof he brings this Suite &c Levin Gale P Quer pledges &a Jno Doe R Roe
the force and Injury When &.a And Prays Leave to Imparle hereunto untill the Next Court and he hath it & the same day is given to the afd Edward Chapman here also &a Att which said next Court to witt the Ninteenth day of March Anno Dom One thousand Seven hundred and twenty seven Came againe as well the afd Edward Chapman as the afd Rowland Beavins by their attorneys afd and whereupon the same attorney of the afd Rowland saith that he is not Informed by the same Rowland his Clyant of any answer for the same Rowland to the afd Edward in the plea afd to be given and nothing Else thereof Says by which the same Edward Remains against the afd rowland thereof undefended &c Whereupon the afd Edward by his attorney afd Prays the Justices to assess the damages of him the Same Edward in the Plea afd according to act of assembly in Such Case made and provided Whereupon all and Singular the premisses by the Justices being Seen and heard and fully understood and Mature deliberation ^thereupon^ had It Seems to the Justices here that the afd Edward hath not Sustained any Damages by Occasion of the premisses afd Therefore it is Considered by the Court here the |
