1727 77 the said Thomas his promise and assumption af in form afd made not regarding but Plotting and fraudulently Intendind him the Same Allexander in that Part Craftilly and Subtilly to defraud and Deceive he the afd Sum of Eight hundred and twenty two Pounds of tob.o or any part thereof to the Same Allex.d hath not paid Altho the same to do the afd Thomas afterwards viz.t the same day and year afd at the County afd and within the afd Jurisdiction by the same Allex.d was requested but he the same hitherto to do hath altogether refused and still doth refuse whereby the same Allexander says he is worse and hath Damage to the value of Eleven hundred and Ninty Nine pounds of tobacco and thereof he Brings this Suite &c Levin Gale P Quer Pledges &.c Jno Doe Richd roe M.r Thomas Maddox Dr To your promise to pay me the Ball of rachell Porters acc.t which was £3..8..6 in tob.o at 1.d p.ll 822 Errors Excepted P Allexander Wordie And the afd Thomas Maddox by George Dashiell his attorney Comes and defends the force & Injury when &.c and prays Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the Allex.d Wordie here also &c Att which said Next Court to witt the Ninteenth day of March Anno Dom one thousand seven hundred and twenty Seven Came again as well the afd Allexander Wordie as ye afd Tho.s Maddox by their attorneys afd and the afd Thomas Maddox by his said attorney as before defends ye force & Injury when &.c And saith that he did not assume upon himselfe in Manner and form as the Plft against him hath Complained and of this he puts himselfe upon the Countary &c And The Plft Likewise Thereupon Command was given to the sherr of Somersett County that Immediately he Cause to Come here twelve &.c by whome &.c and who Neither &.c to recognize &.c because as well &.c of which said preceipt the said Sherr to witt Fran: Allen Gent now hereat to witt the same day and year Last Mentioned Comes and Makes return that he hath here ready twelve &.c as by his said preceipt he was Commanded and now here afterwards to wit the same day and year Came as well the afd Allexander Wordie as the afd Thomas Maddox by their attorneys afd and the Jurors of that Jury therein Impanneled being Called Likewise Came to witt William Turpin, Edward Beachamp, Thomas Dixon, Thomas Billins, Thomas robins, Fisher Waltom, Parker Selby, Robert Collier, William Handy, Robert Mitchell, John Pope, Thomas Peal, who being duely Elected tryed and Sworn ^to say the truth in the premisses^ upon their Oath do say that the said Thomas Maddox did assume upon himselfe in Maner and form as the afd Alexander above against him hath Complained and do assess the damages of the same Alexander besides his Costs and Charges to Eight hundred and twenty two pounds of tob.o and for those Costs and Charges to one pound of tobacco Therefore it is Considered by the Court here the Ninteenth day of March anno Dom One thousand Seven hundred and twenty Seven that the afd Alexander Wordie Recover against the afd Thomas Maddox Eight hundred and twenty three pounds of tobacco his damages afd by the Jurors afd in form afd assessed as also six hundred and Twenty Six pounds of tobacco for his Costs and Charges by him about his Suit in that Part Expended by the Court here of his assent of Increase adjudged which Certain damages in the whole do amount unto Fourteen hundred and forty Nine pounds of tobacco and the afd Deft in Mercy &c
